After the judge pronounces…

What is the next step please? And timelines? My online tracker says -

A judge will 'pronounce' (read out) your conditional order at a hearing. The hearing will take place at Birmingham Civil and Family Justice Centre on xxxx

You do not need to come to the hearing, unless you want to object. You must contact the court by xJanuary 2023 if you want to attend.

After your conditional order has been pronounced, your husband will then be able to apply for a 'final order' on false. This is the final step in the divorce process and will legally end your marriage.

My experience was nearly 30 years ago, and the steps were called decree nisi (conditional) and absolute (final) - no court attendance required unless things are still in dispute. It used to be 6 weeks between them.

I don't recall having to apply for the final order, it just 'converted' in the absence of any other input - I may have forgotten or it may have changed.

Has your financial order been approved and finalised? If not, you should get this part completed between decree nisi and decree absolute.

Thank you - this is the new no fault divorce, hard to find any info!

I'm doing No Fault and nearly at the end! After your conditional order is pronounced you need to get your Financial Consent Order completed and submitted to court. You can apply for thr final order of divorce 6 weeks after your conditional- you will be given the date on the portal. But it's advised to wait until the court approves your finances to do so. I've done my Consent order through a solicitor, now waiting on thr court approval and can apply for the final order on 2nd Feb, providing we've had thr finances approved by then!

@prettygreenteacup hi, how long did it take for your conditional order to be granted?

Humanswarm · 03/05/2023 14:56

@Meg1313 Hi Meg, I applied for divorce last year on the 5th Sept. Had to wait until the 24th January to apply for conditional order. Conditional Order was pronounced on 16th March. Final order came through 28th April. Literally signed the final order online at 6am last Friday and the Order came through by 9am..Divorced!! YAY!

Meg1313 · 03/05/2023 16:13

@Humanswarm hi! Thanks for the reply, I ask because my partner can apply for his conditional order on the 24th, and we had our wedding booked for august 18th! But it didn’t give us enough time to get all the documents and give our notice. So we’ve rebooked it for October 13th to be on the safe side!!

Humanswarm · 03/05/2023 17:27

@Meg1313 ah, probably for the best! Glad you've sorted it! Hope you have the best day!

This. And any child custody. The financial agreement (hopefully you can agree and get a consent order written up) along with the full legal financial declarations on form E and D81 (solicitor writing your consent will want to see from E normally and both solicitor and court need D81).

need to make sure all signatures made and documents submitted by solicitors (leastways back in 2021 petitioners could upload facial docs only solicitors had access but might have changed), before the final order as court seals agreement at same time as the final order (decree absolute as was)
