Hearing after Divorce has been settled

Hi, just looking for some advice. My ex received a letter today (I haven't received anything yet) stating there will be hearing to discuss the settlement we both signed off on. We have already finished the divorce and money has been paid out. I did feel my ex underpaid me on the house (he kept the house and still lives there) he bought me out for about a quarter of the house's worth but he insisted this is all he could afford. I wasn't in the position to get a solicitor at the time so just agreed to what he was offering. The letter mentions one party being unrepresented and the split is disproportionate. I didn't file an appeal because to be honest i just want it all behind me. Has anyone known this to happen to them?

I don’t know much about this but I am beginning a separation. My husband says he will refuse to sell the family home and I will have to take him to court.

When I have told a couple of people about this and how it might be easier for me to just take a lesser amount, they have both said “a judge won’t sign off a settlement like that”.

This sounds like a good opportunity for you to get a fairer settlement. I know you say you want it behind you, but it may be in years to come you bitterly regret not going for it.

Most solicitors will give an initial free consultation.

Thanks, I’m just hoping that when he speaks to a solicitor they’ll make him see how unfair he is being. It’s no good me telling him as he won’t listen.

But do you think you can use this opportunity to get what you deserve?

The mumsnet wisdom is to ALWAYS get a solicitor. Yes, it costs, but it can make sure you don’t get shafted by your ex. Some people have posted that there can sometimes be a way for the solicitors fees to be paid after you get a settlement.

I really hope you do this. I know it can be hard. I’ve been ground down by my husbands behaviour and entitlement. That’s why he’s got a workshop full of tools and machinery, and vintage motor cycles worth more that £65, 000. All my hobbies stuff doesn’t come to more than a couple of hundred quid. He could afford all his extravagances as I am very frugal, because I care so much about climate change. If we have to split income/pensions 50/50 then his day to day spending will have to drop by 90%.

So please do what’s best for you, not him. I wish you luck, but more importantly I wish you some of the anger and persistence that is keeping me going.
