Consent Order / Financial Clean Break

This may seem like a stupid question, but I can't find anything clear online.

Can I get a CO / Clean Break after my divorce?

I asked for one when I applied online, and prepared paperwork assuming it would be asked for, but now I find myself divorced - the Decree Absolute came through last week! What should I do? How does this happen? What did I miss?

Yes just send it off the courts with the court reference number attached. You don't have to send a consent order off so it is never asked for. You send it once nisi is pronounced and before absolute is finalised. However if absolute is finalised you can send it at any point after, just do it as soon as possible otherwise the other party can make a claim.

I will send it off today then. My heart just sank when I realised that it hadn't been accounted for and I was suddenly divorced!

It's always recommended to do it before but not necessary, my husband had to do the same with his ex wife, we had our wedding impending and it was the height of covid so plowed on with absolute whilst waiting for consent order as it had came back. It's a good job we did as the consent order took 7 months and was only finalised a week before we got married 😂

Wow! That's a long time!
This thread has been very reassuring as I think he'd just wait and then get as much cash from me as possible in a few years time so it's such a relief that I can still do it.
I was thinking I'd have to sell my house ASAP....

I don't think the wait times are that long now so that will be great news for you.

My husbands was that long as it was sent in, took the staff a month to do anything with it then the judge was working from home so had to come into the court to pick them up, then make a decision then drop it back at the court, then you had to wait for staff to do anything. The judge wanted further information so we had to send that, and again it took a month to do anything with it, judge had to come pick it up then had to wait for the judge to come back in and drop it off!

Hope you get it all sorted quickly and rubber stamped so you can move on, but congrats on the divorce :)
