no fault divorce! Ffs

Just been told i can't put adlutery on divorce because of the new no fault divorce...surly theres still a choice. I was told last week by the same firm that i could still put adultery and name the OW.

Anybody know?

I don’t understand this need for revenge and blame some people have. Surely the best revenge is to get the best settlement for yourself and to move on and be happy? Nobody will be interested in the reasons for a divorce. My ex had affairs and was a general arsehole, I was only concerned with getting rid of him as cheaply and quickly as possible. He certainly doesn’t sound like he’s worth your energy!

I'm in NZ, and the only reason for divorce here for many years has been "irreconcilable breakdown", which is much the same thing. Just go with it, what does it actually matter?

'Infidelity is a symptom of larger problems'

This is very much victim blaming. Some cheaters are just selfish people. Eg I know someone on their 6th marriage all affairs. Surely he is the common denominater? Or was he just unlucky there happened to be 'larger problems' in all his marriages?

I divorced on adultery grounds and it didn't take any longer and I got a court order for exH to pay costs.

Jelly-yes some people are just arsed but vast majority of affairs in my view happen due to problems/unhappiness in the marriage. It’s not victim blaming just acknowledgement that in general a marriage that’s broken down generally has problems on both sides of the partnership

in any case, the reason for divorce doesn’t impact settlement and no one cares what’s on the form so just put anything down and crack on

Just to add to this it is incredibly difficult to actually prove adultery to the court unless you or another person catches them mid "flow" and captures evidence then things like txt messages etc prove nothing or they admit it. Its not worth the agg/time/money IMHO. Just get it done out the way and move on

Irrelevant now. You can’t divorce for adultery or unreasonable behaviour.
law has just changed
one reason only. No blame. One set of timelines taking min of 26 weeks

Same sex couples and civil partnerships have to find another reason to dissolve their partnership i.e. unreasonable behaviour. There's a top ten list of unreasonable behaviours cited for divorce regardless of the estranged couples' gender.

No he didn't. The marriage contract is a union of assets (and liabilities), it has nothing to do with sexual fidelity.

This is no longer relevant…there is ONLY one ground for divorce now. Law changed in April. Only no fault. All divorces will now be min off26 weeks
