It's just a big battle. I'm bored if I'm honest.
My solicitor is great. She knows what I want and what she can do. It's just affecting my children now and causing stress.
Main issue is he says one thing and does another. And his hidden finances have now come out.
Started out being all 50/50 fair.
Since found out his pensions were valued at a lot more than he offered to share.
He says it's his solicitor playing hardball and he wants to come to an agreement.
I want 70/30 house split in my favour. I've sorted mortgage for this (not easy as I'm a carer for 2 disabled children and earn low wage).
He's now put a 'trust' saying he accepts 30% now but wants 30% more if I live with someone for 6 months. So he actually wants 60% of house.
I've even agreed to disregard his pensions (valued at £56k market).

He won’t get more if you live with someone down the line but it’s usual to have triggers such as cohabitation/remarriage/children turn 18 etc etc

I guess I just don't understand how he can ask for the majority % of the home. It's where I work and care for all his children.
Selling the home isn't an option as the equity isn't enough to buy another home let alone 2 so we would both end up renting.

Will he put a time limit on that?
Ie if you live with someone for 6 months within 5 years? Or until your youngest child is 18?

As stated the courts will agree a split if you can’t agree
They will also decide ether you need to sell to release the money or buy him out or whether that’s deferred ( a mesher order) and whether or not you need to release him from the mortgage etc

If that is say 30% a court won’t increase that at a future date. What they will do is put parameters and triggers in regard to that 30% ie due within 14 days of absolute or that you endeavour to give it within a timeframe or that it’s triggered on cohabitation or marriage or your children turn 18 whichever is first

Without knowing all your details we dont know if 70:30 is fair but your solicitor will be advising that. His current ‘offer’ is clearly a no

I want a clean break. There is no mortgage for him to be released from and house is only worth £120k.
He will get more than enough to put down on another property and could easily raise a mortgage. He has 15+ working years at £30k earnings.

Like I said I've struggled to find a mortgage company who would lend to me. I can afford to pay but my income is mainly benefits due to being a cared which doesn't look to change for the foreseeable future.

I guess I'm just bored of it now. My final offer is the best I can possibly do and it's been a battle to get here and yet he's adding in these clauses to cause me more issues and try and control me I guess. And it wasn't linked to son turning 18 etc it was purely worded if I lived with a partner for 6 months!

Can I ask who you have managed to secure a mortgage through? I am in a similar situation, in that my income from employment is quite low and benefits make up a reasonable proportion of my income and I am struggling to find a lender that would offer me a mortgage.

I hope you manage to get him to agree to a more reasonable deal. Does he want you to buy him out now, giving him the money but remortgaging, but pay him extra later if you then live with someone further down the line?

Exactly. My solicitor says I need to look at it like he wants 60% half now half later which is ridiculous

I would recommend l&c broker they found me mortgage company willing to lend of low income.

60% split in his favour seems highly unlikely given you are the children's carer and are on a lower income. Do you have a good solicitor?

My solicitor has said she won't settle for less than 70% split In my favour. If he agrees to that and closure he can keep his pensions. I just want to secure the house for my kids and so he has no hold over me.

We have literally just agreed a financial offer and break. I'm giving him £47250 and then we divorce absolute clean break.
