Why is Lawyer refusing to mention kids disabilities?

I'm seeking a Separation under Scottish law as a prelude to Divorce.
I am receiving Legal Aid as I am in receipt of Carers allowance & IS.

Ive been given a trainee (takes 6 weeks to reply to emaisl then calls & says: 'sorry its just gone nuts here').

I've asked for the fact that both children have ASD and DLA to be included in the Separation Agreement but been told it's 'unneccessary' twice now. This is the reason for the Separation / Divorce (ie no 3rd parties involved but H has been utterly useless re the kids & moved out as it 'was too hard'). I'd like this included. He does almost no contact with them. they will need support for much longer than average. None of this is written down.

I've also been told that I will be charged for the portion of the work which covers the transfer of pension portion (as a capital gain) but that the firm can give me 'no idea' of what that might cost me, even a ball park £200 vs £2K figure.

Can I move lawyer? Is it worth it? (no money or equity really as H only earns 30K but he has a 20 year final salary council pension)

Ask to speak to the senior partner/head of firm, explaining your concerns. Follow it up with an email so that there is a paper trail.
You can move firms but it is always difficult and time-consuming - better to get someone qualified overseeing. They might be busy but they can still represent your interests .

I agree it's worth raising this with the lawyer's supervising partner and doing so in writing. They will have a complaints process.

I'm not in Scotland so it may not be the same, but I have been told to avoid including anything too unpleasant about the XDH's treatment of the DC (and there is plenty) to make sure that XDH will be willing to sign the papers rather than contest them. Could the advice you're getting be for a similar reason do you think?
