Force house sale

My ex is taking me to court to force sale of our jointly owned house.

Separated 8 years, I've lived in house with our 2 young primary age children in house and paid the mortgage by myself. I'm primary carer, ex works away (in the forces).

House was only bought 3 years before we separated.

My part time salary isn't enough for me to take on mortgage by myself.

Does anyone have any experience of this and wonder what the outcome will be?

Think most posters have covered everything for you.

But I would:

  1. contact a solicitor - you’ll find some may offer you 30mins-1hr initial time free. This will help you decide if you really should get a solicitor. You may find you lose out long term if you don’t get proper support now.
  2. most cases - if you’ve lived alone and paid the mortgage then the extra £ you’ve put into the equity of the house should go towards your share.
  3. if he’s in military housing then the courts will most likely support in not allowing him to rush in selling the property unless he’s got a compelling reason for him to need his share of the cash.
  4. if you’ve put in £s throughout the ownership of this house then whether you’re married or not shouldn’t impact it to heavily.

But honestly I’d really say, get that legal advice, saving a few quid now may cost you thousands.

Best of luck!
RJ
