Statement of Information

This was once a Form E and a friend had to give salary slips, statements alongside it.

My stbxh and I need to sign a Statement of Information. It does not require bank statements and my ex is able to leave off any information about his businesses. Apparently this is ok as they are deemed to be income generators and not profit making companies.

The consent order does not give any reference to a new company set up days after we separated.

Does this seem correct?

I'm confused.
Where have you got to in the process: has either of you issued Form A?

If you're concerned your ex is hiding things then it might be worth taking advice about issuing a Form A and going through the formal process as you'll both be required to give full disclosure.

Absolutely don’t trust him to provide information. He has been very deceitful during this process surrounding the finances.

My friend completed a Form E. I understand this has changed to become the Statement of Information that we are required to complete.

We have finally reached a conclusion on the consent order but in order to send it off we need to complete the Statement,

However - it doesn’t look like he needs to disclose his businesses. Therefore how does the judge know when signing off if it’s fair when he only discloses the money he takes every month (ltd company so dividends and salary).

Who told you it's changed to a Statement of Information?

I only went through this process this year and we had to use Form Es. I don't know if that's because we went through the court . We had to disclose everything, including last 12 months' bank statements - and update this disclosure before each hearing.

If you don't fully know what his assets are, how can you reach agreement? You'll be working on partial information. I can't see why he doesn't need to disclose his businesses? Has this information on what is/isn't required come from him?

Have you taken any legal advice?

Thinking back though.. even before we took finances through court and were at mediation stage, we still completed Form E.

I just don't see how you can reach any agreement unless you can be sure that all finances have been disclosed, so I'm a bit confused here.

A statement of info is completed alongside an agreed consent order so if you don't agree with the terms set out in the consent order then you need to submit an application so basically the judge decides which is when a Form E is completed

If you do agree with the terms set out in the drawer consent order then it is cheaper for you to complete a statement of info

OP in this circumstance, it sounds that you'll need to make an application (Form A). It's fairly straightforward to do, I did it myself as a litigant in person.

Thanks @theworldsgonefeckingmad that makes a lot of sense. Consent order has been agreed but I thought we would still need to formally disclose finances for judge to know whether order is considered fair.
