Have started divorce proceedings. OH has responded saying he won't defend and have filed online application for Decree Nisi. Anyone got any recent experience in how long this takes please? Just want to get it done and get on with my life. Both still living in same house with kids and its really not fun ☹ need to get decree Nisi so I can get started on financial order so I can sell the house as neither of us can buy the other out.

Hi, I applied mid September and was accepted by court and read by judge just this week. So 4/5 weeks which took me by surprise.

I think it was a similar time frame for us too.
Ex husband started the proceedings online in August 2020, I did not dispute anything.
The Absolute came through about 2 weeks ago so the whole process has taken about 15 months from start to finish.
It was very uncomplicated as neither of us disputed anything. However, the things that did hold it up were:
Ex husband wanted to do everything DIY (in order to save money) - I finally saw sense and got a solicitor after a few months. I would have got totally screwed over if I hadn't got a solicitor.
The pensions report took a good few months - we should have done that a bit sooner. We had to wait for it before submitting the consent order and pension sharing annex.
We are still in the same house even though we are divorced. Hoping the sales process will go smoothly.

Thanks. Thats really helpful. Do you know if I will need a pensions report if we are agreeing not to have any claim on each others in the consent order?

I'm not sure Minnow13. We had mediation which was helpful and were told by the mediator and my solicitor that we should get a pensions report. I think that the court do want a pensions report if the pensions are worth over £100k - even if you have both said you don't want to make a claim on either person's pension. Your solicitor will be able to advise on that.

The pension value (CETV) is a mandatory requirement for the Courts in your consent order as part of the full disclosure your finances. It should not cost anything to ask your pension provider to give the amount report to you. However, if pension is in payment then it could cost a lot to pay for the report. The Courts need to know to make sure their decision is fair on both parties. It's the Judge that has the final say at the end of the day as I understand it since whatever agreement you come up with, has to be approved by the Judge.
