£1600 fixed cost for a divorce lawyer and that includes court fees?

Had my half hour free chat this morning with solicitor. She has a set fee and says she can do a payment plan.

It's been 3 years in November.

I don't think ex will fight the proposal but lawyer reckons he has 2 choices and both really equate to him signing the house over.

Mortgage fee. Only with £80-£100k. When factor in joint debt and pensions etc the easiest way is to sign house to me.
3 kids, 2 under 18 and one disabled and 21 so classed as vulnerable adult.

Everything she said made sense and she assured me a judge would never agree for house sale as it's also my place of work.

So...... £1600 for a divorce?

That's we are mortgage free house only worth 80-100k

That’s almost exactly what I’ve been quoted - ours is very straightforward.

Levithecat · 29/08/2021 18:20

By that I mean £1600 is about right for a relatively clear agreement/no obvious areas of disagreement

Chocobuns · 29/08/2021 18:20

£1600 , does that include the divorce, finances and child arrangements or just the divorce?

Bonkerz · 29/08/2021 20:17

That's everything included. If he contests and wants to fight that price will increase but the £1600 includes all paperwork and court fees without a fight.

If you can agree u can do all but draft the consent order yourself and solicitors told me it's quicker to do yourself. I have just done it online took less than 5 weeks for decree nisi to be pronounced. Went to solicitor to draft consent order which is with court now. Should go through as fair and all agreed once that's done have to wait rest of 6 weeks before apply myself online for decree absolute. If goes to plan will have cost £1090 all in between us splitting 50-50 and taken less than 3 months. I would see how much can agree between u before pay out 1600

@Bonkerz then its an amazing price, I've paid lots more so far and still ongoing but i knew he'll be difficult and wanted someone who could deal with him - if you're in speaking terms and agree on things you're saving a fortune ! And like already said the more you do yourself even cheaper...theres a few videos online on how to fill in the forms too Smile

@Kittycat2019 decree nisi in 5 weeks ?!?! Wow, I'm still waiting to hear its been over two months Sad , had to call court but so busy they had to transfer mine to another court in the country...so not even a date as yet .... we agreed on finances now too so it just needs submiting...

Bonkerz · 30/08/2021 08:38

He will either agree because he wants to act the victim and I'm a horrid evil person OR his family will step in and cover his costs because I am a horrid evil person.

I'm fed up of feeling like I need to be nice (reduced maintenance, helping when he needs something, last time was helping him sort new phone contract) because I don't feel safe in the house.
We need everything sorting now because I need to cut our marriage off.
I've warned the kids it may be bumpy, not because I think he will fight but because he will play major victim and be depressed etc infront of them

Depends on value of debt and pension as to whether he thinks it’s a fair outcome
Does he also have a solicitor? If not, a judge might not sign off the order unless they’ve had independent legal advice

Fee seems reasonable - but usually it’s the financial settlement that racks up the bills, not the cost of the divorce part itself, so if you can both agree then no need for it to cost loads

PicaK · 30/08/2021 09:21

What is the 1600 actually for?

GentlemanJay · 30/08/2021 11:10

Please don't fall into the issue I had.

I got a similar quote. That was the Decree Absolute. It did not cover any financial arguments or order.

You need to be careful because if you are doing there two things at the same time, the invoicing becomes clouded and confusing.

Bonkerz · 30/08/2021 11:19

It covers all the paperwork including court fees.

I don't think he's expecting it to be honest. He's happy to carry on as we are.

House mortgage free worth £80k ish. He has £27k pension, I have none.
We both have equal debt.
In 3 years he's paid me £1800 for kids.
He still underpays me by about £80 a month.
I have 3 kids still at home. He has open door access but spends about 6-10 hours a week with the youngest.

Neither of us has the money to fight and with the house not being worth much I don't think it will be worth the court fees and just hope he sees that.
