Taking stbxh off mortgage before buying out is it possible

Hi I am trying to work out the best way forward. Decree nisi is done, consent order drafter signed and due to be submitted Monday. I am buying stbxh out of the house have until 2026 to do this. Hoping to do it within next 6 months but it is dependant on parents selling nans house the. Gifting me the money to do so. Just never know how long this house sale will take. Can I take over the mortgage into my own name before I buy him out of his equity Want it clear house is mine and he has no right to enter it or move back in. Things are amicable to date but want to protect what is mine. I have paid mortgage on own since seperation in June.

Normally the bank would only remove him from the mortgage if you'd qualify for the whole mortgage on your own so you would need to speak to the bank. They'd then arrange a mortgage application just for you.
My sister had to do this, even tho she'd been paying the mortgage on her own for 4 years on paper she didn't qualify for the mortgage and ended up having to sell.

You would need to apply for a new mortgage in your name only. You could look to set up an an agreement that you buy it from him at a reduced price with you owing the money to him, due by x date. He would need to agree, and you would need to be in a financial position to be able to take on the mortgage alone. You would also need to explain the reduced price to a mortgage provider, and not all would be happy about it.

This is a question for your mortgage provider but they'll probably say no. Just wait for your lump sum to come through and change the locks in the meantime.

Thanks everyone I can afford the mortgage on by own just. So will speak to mortgage provider see what they say . There a buyer in place for the house but a renovation project so this is third buyer first 2 dropped out. Wil give it few months wee where I am but determined to go into 2022 on my terms

Do you mean you can just afford it because you are currently paying it or have you done a mortgage in principle application? If it only the former then you will probably not be deemed able to afford it by a mortgage lender when those payments are stress tested.

Run through affordability on phone with the bank was just able to make it although not full application

I effectively took over the mortgage I had with ex. It was a good deal I didn't want to lose! If I recall correctly they opened a new account under the same terms.
You might find though that there are better deals available now and more economical to start afresh.
I'd also being paying it myself for some time.
In terms of my salary I didn't qualify in the first instance but they took tax credits in to account and the fact I had no other debt and been paying and also saving (and so could weather interest rate rises). The application was sent to the underwriters and was approved.
Make an appointment to speak to them in person.
It will be advantageous to your STBX to get him off the mortgage asap so he can start his own.

You need to ensure the order provides for him to transfer title without you paying his lump sum. He will need to know how his share will be secured if he transfers title now.

I spoke to nationwide they are happy to take cm into account as long as I can show been paid at least 3 months which it has .
I am represented but consent order reads like payment to time with transfer of deeds good news is sale of my man house looking good for a completion date 31 October . Fingers crossed then timing could work out well
