Chocobuns · 29/07/2021 13:20

Hi, in your cases how long it take from application for DN to receive certificate of entitlement and how long after was the DN pronouncement, please?

I submitted SOT and it's been a few weeks now and haven't heard, thank you

I take it you mean decree nisi? It can take a good while but depends on the court you go to. Mine was about 9 months, but that was 2 years ago.

Chocobuns · 31/07/2021 15:14

@Otter71 thank you, I applied for DN and solicitor said you get a certificate of entitlement first and that states the DN pronouncement date....I suppose I'm waiting for that certificate but interested to know people's timeframes

9 months !!! Wow, think this stressful situation is getting to me and want it to end asap so might be getting a bit impatient but want to be realistic too

What's a certificate of entitlement? Decree midi and decree absolute Ive heard of - not your thing though?

Chocobuns · 31/07/2021 15:19

@CandyLeBonBon apparently its the paper that tells you when your DN will be pronounced....or do you just get DN straight away from apllication? Not sure...

OP posts:
Otter71 · 31/07/2021 15:33

Yeh you get a letter saying it will be heard on this date.

Chocobuns · 31/07/2021 16:21

@Otter71 think thats the one I'm waiting for...

Chocobuns · 20/08/2021 09:21

Still havent heard....I'd really like to see other people's timelines from when you applied for decree nisi, how long was it before you heard? Whats a reasonable amount of time to wait before contacting the court for an update?
(Btw its St Edmunds)

I applied for divorce in October 2018, financial resolution hearing March 2021 both parties agreed settlement. I am still waiting for Decree Nisi and money at this moment in time!

Chocobuns · 02/09/2021 07:06

@nanasusie thats an awful long time!! When did you apply for the actual nisi? I thought the financials cant be addressed till nisi is pronounced?
i hope you hear soon Flowers

They have to be done side by side, it has cost me nearly £12k I am fed up with it all. I didn’t even have 2 year separation period imposed before I could for go divorce it was an abusive marriage!

Shibby585 · 04/09/2021 20:31

My husband was divorcing his wife last year. Applied for Nisi in June, heard back September (Bury St Edmunds). For the paper to arrive. It was about 2 to 3 weeks after that for pronouncement (start of October)

Shibby585 · 04/09/2021 20:38

Just for a little info about Bury, although I'm not sure if this is still the case, during covid the paperwork would be sent in.

I.e. Apply for Nisi, it was taking a month for the admin team to do anything with it, then a couple months for the legal team. Anything financial was sitting in a pile for 1 month then a judge would come and pick it up, take it home, it would then sit at the judges house until they brought it back to court and it was then passed back to admin to deal with.

Hoping things have sped up a bit now, but just be prepared, it was a slog for us to get sorted (started proceedings in October 2019 and finished in May 2021, although we did have a lot of delays due to her not signing, issues with marriage cert and queries by the judge which all slowed the process).

Gensola · 04/09/2021 20:54

My DH and I both got divorced at the same time from previous marriages (it is actually how we met!) - we both submitted our divorce petition in Feb 2019, cert of entitlement came quickly, I think we both had Nisi by April 2019 but then financial stuff started to be argued over and our divorces didn’t come through until June 2020.

Chocobuns · 04/09/2021 21:08

Thank you for this! Apparently, theres a huge backlog and cases are re-allocated to speed it up...so who knows when it'll be...Hmm

Our experience with Bury during the height of pandemic was 1 month to go to legal, 2 months (maybe 3) to get back to you and a couple weeks to pronounce. The bit that will take you the longest is possibly the financials.

Nanasusie · 04/09/2021 22:37

I spoke with the court yesterday and they said it is with the legal team and I should hear by August 25th. I said that was week past Tuesday, she said oh ! It shouldn’t be long then 🤦‍♀️

Chocobuns · 05/09/2021 05:41

@Shibby585 its just so frustrating as under same roof till thats done.... so financials, even though they're agreed already how long did that take, please?

@Nanasusie when did you actually apply for DN? Mine is with legal team too but havent been told a date i should hear by...

thelonggame · 05/09/2021 08:09

I've done mine online and been really surprised how quickly it progressed.

Applied on 26 June.
Petition sent to STBXH on 1 July.
Certificate of Entilement 1 August.
Decree Nisi issued 26 August.

I can apply for Absolute on 8 October, but won't be doing until we have sorted out the financials and lodged Consent Order

Nanasusie · 05/09/2021 11:18

Applied for DN and ex signed his in November 2018. May 2019 financials started and then all sorted March 12 this year. All agreed and ex paid money to his solicitor who is still holding it. I am in limbo at the minute!

Chocobuns · 05/09/2021 13:04

@thelonggame thats interesting, theres only a week difference between our dates and I'm still waiting...

@Nanasusie i feel for you... so i take it you're due money but cant be released till this is done, what a nightmare, hope you get sorted soon

OP posts:
Shibby585 · 05/09/2021 13:21

When we did it we sent the financials off the same day as decree Nisi was pronounced which was October 7th. The judge then queried something on this in December and then it took us until May to hear back and have it finalised.

We had a lot of emails with Bury and my understanding is it takes the admin team a month to sort, the judges were working from home, picking up work and dropping off. Completing it then dropping off in the office when picking up the next amount.

This was obviously the height of covid so the judges may no longer be wfh and it possibly won't take anywhere near as long.

pointythings · 05/09/2021 16:06

Bury St Edmunds was a hot mess even before the pandemic. My application went in January 2018, nisi would have been pronounced 12th August 2018. Except that my husband died on the 1st so we were never divorced at all.

Turned out to be a silver lining though, he had no will and I inherited everything.

Nanasusie · 16/09/2021 13:35

Finally received news today that Decree Nisi will be heard on 11th October, and ex has been ordered to pay costs. That will go down like a lead balloon.

Chocobuns · 16/09/2021 13:58

@Nanasusie woohoo Flowers
Still waiting here ....
