How do you a avoid this in divorce?
Do they all make sure both parties are homed?

Assets will be split depending on each party’s needs and, primarily, to ensure the welfare of the children - what happens to the marital home will be very much dependent on what’s needed to make sure the children are adequately housed.

Courts can’t make sure everyone is homed though, that’s your responsibility. If finances and the situation means that the house has to be sold, it will be both of your responsibilities to take any proceeds of the sale and buy or rent a new home.

You need proper legal advice. There are far too many variables for anybody else to tell you what’s likely to happen.

Who's they? The court?
No. They split assets. They sort out the children but homes for the adults aren't provided by the court. If the home is owned you often get the courts deciding that the person caring for the kids stays in the home until the children are 18 but every case is different and there are no guarantees.

The council should offer you emergency accommodation/housing if you have nowhere safe to stay and you have children and meet immigration requirements. You need to speak to the council if you find yourself with nowhere safe to stay.
