My seperated wife moved out 3 years and 9 months ago ...she has lived with her new boyfriend....
Should I ask why she has not included any of his income on the financial form E

No

How come ...

Because her bf's income is totally separate. Not her income or assets so has no relevance to your divorce. It will just delay things

mark53 · 15/06/2021 18:35

But they live in the same house as a couple ....

What has a 3rd party's income got to do with your dissolved marriage?
What he earns has nothing to do with you or your divorce regardless of divorce grounds or fault.

Your wife's partner's income is irrelevant in your divorce

L125 · 15/06/2021 18:48

I disagree. Your wife should have completed box 4.6 of form E which specifically asks for details of income and assets for anyone she lives with so, yes, you should ask why this has not been filled in.

@mark53 I am in a similar position. My STBXH hasn't filled in the section on his partner's income/assets either on his Form E when there is clearly a section that asks for it...

millymollymoomoo · 15/06/2021 21:50

All she has to do is say she doesn’t know his financial details and it is unlikely to be pursued

What are you hoping to get out if it!

L125 · 15/06/2021 21:55

It becomes relevant in terms of deciding the split of assets. In some cases, one spouse has a higher financial need (for example if they need to house children) and if the other household has additional income, then it may be justified to give them a lower share of assets.

@mark53
I'm going through exactly this and my ex omitted his live in partners income. When I queried it with my solicitor she said it has little bearing on what she earns as long as they have declared they are living together the judge ( in my case) will see there are two incomes coming into the house
