Form E refusal

Hi there, my STBXH would prefer to mediate on finances. I would prefer and am trying to get him to exchange Form E. I no longer trust him (long affair and I have reason to believe he has been filtering money away/won't fully disclose). He's also very controlling so I would struggle in mediation. I understand I can go to court to 'force' a Form E exchange but does anyone know if I do this what the timescales and cost would be, and whether going to court to request Form E exchange then means I am stuck using court to determine outcomes? Thanks in advance

If you file a the forms yourself, then it costs in the middle hundreds to file Form A and start court proceedings. The timetable will be set by the court, and there will be a couple of months before he (and you) has to file form E.

Then a couple more months until the FDA when you can file a questionnaire to find out more about things he "forgot" to include.

If he is already hiding or sequestering assets then I think you need a solicitor to advise you on getting emergency orders to stop him doing this.

Good luck.

It may be worth you speaking to a mediator. We are going through mediation and we both had to fill in form E as part of that process and go through them in detail.
