form A filing to timetable

superwoman232 · 12/03/2021 19:11

How long does it take from filing Form A to getting a timetable from the court?

HosannainExcelSheets · 13/03/2021 16:09

Mine took a few weeks to get a timetable, but the FDA hearing was 6 months later.

noideawhatusernametochoose · 14/03/2021 13:46

The Court lost my form A intiially, I only found out when I chased it up after 2 months. From then it took 4 months to FDA and then nearly 5 months to FDR.
I hope we don't end up with a Final Hearing....

Watermelons29 · 14/03/2021 19:12

Form A - sent January 2020
FDA - August 2020
FDR - January 2021 (he didn't agree)
Final - August 2021

Going to a final hearing is going to cost him more in legal fees than what it would have in agreeing to FDR recommendations. I'm dealing with a narcissistic so expected it. Stay strong.

superwoman232 · 14/03/2021 19:52

@Watermelons29 I thought the first appointment had to be no more than 16 weeks after filing. Also dealing with a narcissist and so have to go to court for everything - won't do voluntary exchange of form Es.

@noideawhatusernametochoose are you also dealing with a psycho?

At the moment it really seems dependent on your area and how they’ve handled Covid-related delays.
For me, it’s been:
Form A sent: July 2019
FDA: Dec 2019 - adjourned due to his non-filing of Form E
FDA: April 2020 - vacated due to Covid
FDA: Sept 2020 - vacated due to court staffing issues
Draft order for final hearing submitted: Oct 2020
Order for final hearing granted: Nov 2020
Final hearing: who the hell knows - 4 months on from the order I still don’t even have a date.

I’m told that my area have been particularly bad for delays though, so fingers crossed you’re in an area that’s coped better.

superwoman232 · 14/03/2021 20:53

@Thriwit sorry if he doesn't file Form E he just gets away with it? How long can he delay for? Mine might try not filing but he has a lawyer ...

OP posts:
Watermelons29 · 14/03/2021 20:59

Mine also has a lawyer (hired bully). I put them on notice that I was applying for enforcement when they didn't comply with finance court orders. They started jumping when I sent them the enforcement application. Be ready for the long game.

silentpool · 14/03/2021 21:03

Aug 2020 - filed Form A
Oct 2020 - they finally charged the court fee
Jan 2021 - after chasing continually, they tell me they've lost Form A. I complain.
Feb 2021 - I get a date for the first hearing (Jun 2021).

Thriwit · 14/03/2021 21:24

@superwoman232 My ex didn’t file his, so at the FDA he was ordered to produce it within 2 weeks, with a penal notice attached. So he did file it at that point, albeit very deficiently. But that was Dec 2019! Haven’t had any opportunity to ask any questions or anything about it, and don’t think I will now. But I’m so done with it all, I just want the final hearing and for it to be over now. I’m fed up of being stuck in rental with the kids while he’s in the house I still co-own and am still on the mortgage for!

Hopefully if your ex has a lawyer they’ll basically make him file Form E, because it’s just going to cause him trouble if he doesn’t. My ex doesn’t have a solicitor, so he’s just merrily ignoring the entire situation.

superwoman232 · 19/03/2021 22:13

@HosannainExcelSheets I thought the FIRST hearing has to be not more than 16 weeks after the date of the application. Ie After receiving the application, the Court will list a First Appointment hearing not less than 12 weeks but not more than 16 weeks after the date of the application.

OP posts:
HosannainExcelSheets · 20/03/2021 09:03

@superwoman232 in theory, but if they loose things at court, if there are no available dates, if the respondent postpones because they are unavailable or don't file paperwork etc etc, it can really drag on.

The timetable is theoretically quite short. But that's no guarantee that it will go to plan. But it will eventually happen.

HosannainExcelSheets · 20/03/2021 09:04

It looks like @silentpool has had a similar delayed experience. Covid hasn't helped.

silentpool · 21/03/2021 08:14

@superwoman232 yes as Hosanna says, that depends on the court. They told me they'd pronounced my Decree Nisi and it had not been done, then they lost my Form A...Covid has added more delays.

property has gone up for sale, but desperately don't want to sell the property, are we able to submit a covering letter with form a

Nat1010 · 28/11/2021 20:29

Sorry if this is a silly question but if you are hoping to resolve finances during mediation, do you have to apply for financial order as part of the divorce petition? In other words I hope we will be able to agree on a co sent order to regulate finances… if so do I still apply at this stage?
