Preparing for the fallout of applying for Absolute

I wondered if anyone would help, I've tried phoning the courts but they don't answer.

I submitted my D11 form to Bury St Edmonds a week ago (via post which is quite painful) and am wondering if anyone knows how long it is currently taking to list short hearings? Is it down to the court in your area?

I ask as I am going over my husbands head to get the Absolute sorted and he is going to be extremely angry that he is no longer in control (he is the one that filed and is refusing to apply for the absolute himself as he enjoys holding it over me). I am very very nervous and would like to know a rough timeline of when I should expect the fallout. He will become abusive and I am fully expecting some horrendous emails.

I am starting to bitterly regret not instructing a solicitor for help. They quoted me £500 but I just couldn't afford it, now I'm starting to think it would be been advantageous to find the money just to get the support. I really am a total mess over this.

I really feel for you. It wouldn't matter if you instructed a solicitor or not. The fall out would be the same.

Just make sure you keep any emails, texts, threats etc in case you want to go to the police then apply for a non-mol.

You can do this, it's the last stage of breaking free from his control. Try getting some support from Women's Aid or Citizens Advice.

Flowers you are well shot.

You can apply 6 week after decree nisi. Should have it within 2-3 months given Covid.

Feel for you! Stick to your guns and ignore all discussions about it. Grey rock and good luck for your future!!

Thanks everyone. @HosannainExcelSheets That's made me feel alot better.

@CaramelPops He made the initial application so I was told that I'd have to wait longer than him to apply. Nisi was pronounced in July so it's been a long time now.

I hate how much this has dragged on and on and on. I just wish the courts would answer the phone and give me even a rough timeline.

Sorry to jump on your thread, so if he initiated proceedings, you, the other party can apply for absolute if he’s doesn’t??

The divorce service telephone line 0300 303 0642 are really helpful and compassionate. Or you could email them directly [email protected]. They gave me advice on timescales that were specific to my circumstances and application so they might be able to help you. Good luck.

Ohnotagainsally · 10/03/2021 18:09

Hi @damnthisvirusandmarriage - yes. If the petitioner doesn't apply then the respondent gets the chance to after 3 months. I have applied as it has been over 3 months since the Nisi was pronounced, using the D11and D36 form

Thank you @Getitrightforonce, I spoke to them today and they will be listing it next week, but I got in a tizz didn't think to ask them of timescales. I will call back and ask tomorrow.
