I received some inheritance money just before lockdown last year. This was a week after my husband told me he no longer loved me in an argument. He got over the argument but has now twice said it again when angry with me. I know it is time to leave but I want to know will he be able to get 50% of the inheritance money? He earns more than me and brings this up often that he is subsidising me even though I do the majority of the childcare

How your assets are split will depend on many factors, it won’t necessarily be 50:50

Has it already gone into the marital pot or have you kept it separate?

I believe will be considered, but it is easier if it’s separate. There is lots to consider.

We haven't spent it as we were going to buy the freehold on our leasehold property so it is just sitting in a separate account but it is a joint account

Financially I think we would both be worse off if we split which is why I think he is staying with me because the kids would be worse off. Although it is hard being with someone when you know they don't love you any more

Of the money is spent it won't be part of the pot.

You could possibly put it in trust for the kids.

Check with a solicitor but I'm pretty sure personal inheritance remains personal,ie not part of the family "pot"
Obviously if you spend it it's more unlikely you can get it back

if its in a joint account id move it to an account soley in your name

I agree that it is counted as part of matrimonial assets. My friend received a large inheritance and her husband left her for another woman a few days later (the two things weren’t connected!). He got half the inheritance when they split. He died a few months later and my friend rages at the fact that the OW has half the inheritance her parents worked all their lives to create.

Was that question to me? If so, yes he did. They got divorced and he remarried straight away but he died shortly after.

SIL is in the middle of getting divorced and her lawyer has kept her half of MIL's estate out of it somehow. Maybe there's a financial limit?

My hopefully soon to be XSIL (she had an affair and ended the marriage) told my DB that she was dragging her feet on their divorce in the hope that my great uncle or mum caught covid and died so that she'd get half of his inheritance. My mum promptly changed her will to leave everything to me on the understanding I'd share with DB when SIL was no longer SIL (which I would as unlike SIL I'm not an arsehole). My uncle god love him is 90 plus and not in the best of health but I wouldn't put it past him to wait until the day after the decree absolute before he shuffles from this mortal coil.

My ex mentioned my inheritance when divorcing. My parent was very much still alive. When she heard, She changed her will so if she died before we divorced, he wouldn't get a penny
