Divorce from start to finish in COVID times

Shirleyvalentine2020 · 15/11/2020 17:48

Has anyone started a divorce prior to COVID and it’s is still ongoing or has it been wrapped up and put to bed?

Just asking in terms of timescales. Any information would be helpful to get an insight into the system and delays etc. Thank you

Started 18 months ago. Got my decree nisi a year ago. Still trying to resolve finances. It's my ex delaying, though.

Shirleyvalentine2020 · 15/11/2020 18:23

Are the courts still progressing matters or is there delays there too ?

I’m sorry your having a hard time. Hugs xx

I’ve been told by someone in the know that submitting things online is increasing the chances of getting things processed - but there are delays. At some centres more than others.

silentpool · 15/11/2020 20:14

There are a lot of delays. It might be quicker if it is amicable but anything requiring the courts is painfully slow. I submitted my Form A in August and have not got a court date yet.

Thank you for all your insight. Good luck to you all. I hope it works out well for you all .

Maybe we were an unusual case as we had no property/pensions/financial ties to divide but I applied for divorce on grounds of reasonable behaviour late June and my decree absolute came through start of October. I was not expecting it to be so quick at all, EXH disagreed with reasons but allowed divorce to proceed so there were no hearings or hold ups etc. Good luck to you all, it’s so worth it once it’s all finalised x

RedShark · 15/11/2020 20:50

Not sure if it matters but we do have children (maintainence not dealt with through court) and we’re in the south of the UK (as PP have said, location may matter in terms of how busy some courts are)

HosannainExcelSheets · 15/11/2020 21:13

The courts are really backed up, but if you can agree between you then it should go through relatively quickly.

Wannabegreenfingers · 17/11/2020 14:59

Mine started in March, Nissi heard the 17th September. All done through the court's waiting to hear about the absolute, but was told around a 13-14 week wait.

My DPs divorce from his ex started in April and was complete end of July - entirely online and faster than my own divorce last year which took 11 months. Both of us had already sorted finances etc so both straightforward.

Froggo · 17/11/2020 22:55

That’s going to depend on whether finances are involved, and how amicable or not things are.
Fwiw I submitted my Form A for finances in July 2019 and am still nowhere near getting them sorted. 2020’s pretty much been a write-off for my case, no further along now than I was in January.

Hello all. The other half submitted it online a few months ago, and the judge rejected application saying the reasons were generic .
She then contacted a lawyer and they advised her what to do . She submitted an amended petition at the end of June , and I have had no correspondence since . I rang the .gov.Uk number and was told the judge made his decision at the end of August, and the file needs transferring back to their admin department for someone to type the letter snd send it out. It’s now approaching the end of November and still heard nothing . So basically it is taken longer for me to know what the judge has decided , than for the case to have gotten to him and him making a decision. It’s frustrating .

Bdw119 · 18/11/2020 16:11

Sorry, made an error in the second to last sentence:
I meant it’s taking longer for that letter to be typed up and sent out, than for the case to have gotten to the judge and a decision being made .

PinkCherry · 19/11/2020 22:11

My divorce application was made in April, it's taken on average about 6-8 weeks for the court to process each piece of paperwork.

My Nisi was pronounced 23rd October and my absolute can be applied for from 7th December

Munchkin08 · 01/12/2020 19:47

Got my decree nice 30th January, sent consent order to judge on 21st July and got my decree absolute yesterday.

Bdw119 · 09/12/2020 20:06

Still waiting. Have heard nothing.

Alfierock · 09/12/2020 23:50

I had waited 5 months for clean break consent order approval. After this time they said they can’t process it because they had lost my form A. I was furious. Sent an urgent complaint to them and was approved within 2 weeks.

Bdw119 · 10/12/2020 06:19

How does one go about sending a complaint?

noideawhatusernametochoose · 10/12/2020 12:53

The Court lost mine too. Managed to cash my cheque though! When I chased up after 3 months of hearing nothing, I was advised to resubmit by email (thankfully I had copies of everything), and I've finally got a date. It's caused a few months' delay which is very annoying. My STBEX had caused enough delay already.
silentpool · 09/01/2021 07:03

I filed my Form A in August, payment was finally taken in October and I'm waiting for an initial court date. I plan to call them on Monday to ask if there is any update. It is unbelievably slow.

Hello

I am completing the form D84 to apply for decree nisi.
I am unsure of two things :

  1. what do I put in the “ fee charged /remission ID” field
  2. How many options am I ticking in section A?
