Child custody with young children

Is 50/50 the starting point whatever the age of the kids? Mine are age 2 and 4. I gave up work to be at home with them and have been the primary carer, though they also are used to seeing their Dad and obvs it would be important for them to continue spending plenty of time with him.

We haven't talked about separating yet, but I am thinking about it. The young age of DC's is the biggest stumbling block for me. Not that I'm sure it gets easier when they older, but I do think separation can be harder for very young children.

There isn't really a starting point for looking after kids, other than a presumption that contact with both parents is good, and that the best interests of the child are paramount.

There are more 50/50s being done, but it remains a minority. And, yes, 50/50 tends to be less common for younger kids (as far as we can tell).

I think separation with younger children is easier. They adapt much easier. I don’t think 50:50 is the starting point but you need to have an element of flexibility especially as they grow and routines change.

Courts will prioritise children first.

I suggest you simply work out an arrangement with DH otherwise the court will.

The real question is, is your partner capable and willing?

Ps. My wife left when my son was age 3.

He has adapted perfectly fine to 50/50 residence. A few questions now and then given he is now 4.5. But on the whole is perfectly happy.

If you separate it willl become normal to them.

The key is to have good communication in his development. Whether by email or other.

From personal experience, the emotional pain will hit them in their teens. Due to not having a central family unit. But this is your call to make.
