Mesher Order - Mortgage refusal

Hi, I was awarded a Mesher Order which states that I can stay in the house until my youngest turns 16, then the house needs to be sold. I am trying to get a mortgage but all the 12 main lenders my mortgage adviser contacted are saying that there cannot be any stipulation on the sale date. My only option is to go back to court under the liberty to apply provision.

Has anyone managed to secure a mortgage who had a charge on the house and a sell date? thank you

I thought Mesher orders were granted where a mortgage was already in place? If you alone are buying a house then why does it need a mesher order attached. Surely it's then your house?

There are probably about 80 mortgage providers around. If your mortgage adviser has only contacted the 12 main providers then he doesn't actually sound very good. Get him to contact ALL of them - that's what you pay him for.

The house is in my ex husband’s name and so is the current mortgage. It is all very conplicated, I just wanted to find out if anyone managed to get a mortgage under a Mesher Order, thank you

My OHs EW recently tried to remortgage. My OH is still named on the mortgage as she’s unable to have a mortgage on her own (earns £10k but the mortgage in the property is for £260k).

She can’t remortgage as she wants to remortgage to a 26 month deal but there is a court ordered charge on the property that it has to be sold within 18 months.

The mortgage company will be able to see if there is a charge / mescher order.

So are they saying that because you want to take a mortgage over that date? Ie a 25 yr mortgage and your daughter will be 16 in 10?

Their issue is that they don't want me to become homeless if I am unable to buy a house with my kids at the forced sell date.
