Lying on a Form E

Has anyone else had experience of their ex partner lying on their Form E. My STBXH has lied about everything and still continues to do so. A marriage counsellor confirmed during our marriage he is a pathological liar and actually advised me to walk away and refused to counsel us. He refuses to state on his Form E he is cohabiting with OW and has actually stated that he is no longer in relationship with her. He then threaten me with texts accusing me of making libellous claims about the relationship. I have concrete evidence to support the fact he is living with her. He has also lied about lots of other stuff on his Form E to put himself in the best position financially. Is it worth challenging it in court or just let it go. Im not sure how much his lies will affect the financial outcome but it could slightly tip the balance in my favour so me and the children can stay in our home if I prove his lies. I am just annoyed that he thinks he is above the law and is now threatening me. On the plus side the way he has behaved since we parted has made me realise how glad I am to see the back of this pathological liar and I have not felt so happy in a long time. So do let him get away with his lies or just let it go?

I'm assuming that there are court proceedings? You mentioned court. If so after exchanging Forms E the next direction is to file and serve questionnaires and other docs. Just ask questions such as "The wife is aware the husband has a pension with xx and is asked to provide documentary evidence of the transfer value." Or whatever the lies are about.
The cohabitation is often not very relevant though.

Lied about his bonus, lied about value of personal possessions, lied about the security of his job, lied about where he is living and relationship status. The list is endless. He lies about everything in all aspects of his life I don't think he can help himself! Not sure I can be bothered to put up a fight for what may be very little financial gain. However, morally i dont think anyone should be allowed to lie in a court of law. I think I will put my effort into working my way back up the career ladder and being successful in my own right so I can provide for me and the children alone and be completely independent from him . He can keep his £100k+ salary! What really narks me off is that he wishes the children to cut back on their activities now we're apart yet he can lavish thousands of pounds on himself. So unbelievably selfish. I'm so glad he is out of my life.

Yes I'm not sure the cohabitation is relevant either and I was hesitant about raising it as an issue but did in the end due to childrens proceedings which are also going to court. I just want this divorce done as quick as possible and I don't think it is worth quibbling over every point in court. I was just wondering if anyone had a similar experience of their ex partner lying on their Form E and what they did about it.

Give you solicitor any information you have.He has to supply bank statements so his bonus should be there and his address.His solicitor should also have his correct address as bills etc have to be produced in the money laundering checks.
My ex got away with hundreds of thousands by hiding money,you just have to do the best you can and make sure that they don't break you in the process.

So it is in court? In which case ask for documentary evidence on your questionnaire where you know he's lying. Eg. Bonuses will show on payslips and bank statements that should have been produced with the form E.
Whether to pursue points depends whether it'll be material and proportionate to the outcome. Sounds like it could be here.

If you think he's lying about personal possessions ask for a professional valuation. What personal possessions do you mean? Expensive watches??

I was told if you lie on your form E it’s taken very seriously indeed. Imprisonment in fact.

My OH’s EW lies throughout her Form E. Including stating she didn’t work and what benefits she was in receipt of.

The truth always comes out.

From memory you have to provide circa 6 months of bank statements. Any income will be on those.

In this particular case she was caught out and given a stern talking to by the judge and received only 1/2 of what she ‘demanded’.

Yes I am having the same problem with mine at the moment he lies about his needs expenses like putting he spends £500 a month on food at the moment, or he pays £660 on the mortgage, that he needs to save £500 a month in savings. The mortgage is £330, and there is no way that he spends £500 a month on food. He says his pension is x amount but it's not even when we have proof.
I have to go to mediation in may over this and we are supposed to update our form E for final approval it will be interesting to see what he puts down this time.

Need help, same boat

My mums ex husband is trying to take her for half her house which she rented for 30years before he got with her, his only ever put in 5k towards the mortgage, and left her from only 9 months, of only the house. His name is not even in the mortgage.
And hasn’t paid anything to her in 5 years towards it. We have had his Financial statement and shows that he could have gave my mum money, but didn’t and now only earns £200 a week and a oven cleaner ( used to be a black London taxi driver) we have found out his living at another address which is his gf and has lied on his forms that his living somewhere else ( we have proof of this)
Does someone actually know what would happen to him in court as his a lieing git.

I asked a number of questions in my response to XH's Form E. The judge selected just one for him to answer, but it was the most pertinent one and being in court XH had to answer it. The judge then asked him to rethink his offer, and we signed a revised consent order about an hour later - with me coming out of it on better terms than expected Smile

It’s just wrong for the fact his only put in £5k and wants £150k in return.

Not easy to say without being outing, but it related to money he had received in the period since we split, which he thought he was entitled to have in its entirety but the judge felt I should receive half.

Mine wishes to negotiate without completing the form at all!
Firstly wants as a post nuptial agreement but it basically will become a settlement. Says it’s to avoid court fees and waste valuable money on them.
Says to use a mediator and they will take his word. Not sure they will though.
Can you go through mediation without the form completed?

I am in the same situation: after 15 years together and 4 kids, he decided to leave the marital home and move in what used to be our second home (we moved into a larger property when we had our 3re child, and managed to still hold onto the first home).
He is telling me he is living by himself, but I see a second car at that address every single night.
He told the kids he doesn’t have a girlfriend, but they keep finding various items in the house which are more of a feminine nature.
He lied on the form E about not cohabitating with her.

What can I do?
