I have just read on a post that someone got their decree absolute without Financial matters being resolved. Is that right? I am in a very bad legal battle surely My ex cannot apply for an absolute unless finances are sorted???

If he’s the petitioner, providing 6 weeks and 1 day has passed since the decree nisi was issued then he can apply for it to be made absolute

Yes as stated, the petitioner can apply for the absolute 6 weeks and 1 day after the decree nisi was pronounced, regardless of finances etc being sorted. We got our absolute in December but our consent order has not been sealed yet.

Who is divorcing who in your situation?

Emmab4233 · 15/01/2019 13:24

I am divorcing my husband so hes the respondent and he cannot I believe apply for absolute without going for an court hearing. So I am the only one that can apply?

In that case, he can’t apply for the absolute until your 6 weeks and 1 day has passed, and a further 3 months. After that he can, but I believe it’s not such a straightforward process for him to do so.
