How to leave your husband

Hi,

Just wanting some advice, as I'm about to tell my husband I'm leaving and will be filing for divorce.

My main concerns are the legal side of things. We have no children, no mortgage and no joint assets so am I right in assuming the 'spilt' would be quite simple?

He is in quite a lot of dept which concerns me, as I don't want to have to pay anything towards this once divorced?

I have sorted everything else for myself such as a place to live etc so just planning for doing all the legal stuff in September when I can actually process everything.

Thank in advance for any advice :)

All the assets AND debt are usually divided as part of the financial agreement. You will need to.speak to a solicitor about your specific circumstances. If the debt is for a car for example that your husband keeps... you could argue that he keep the debt also. Find a sol who offer a free 30 mins session.

The legal side of the actual divorce should be relatively simple -- some form-filling basically.
But if it's a long marriage then you cannot assume that there are no 'joint assets' as a court could decide that any individual assets are to be treated as joint and available to be redistributed. That could include savings, but often the largest assets are pensions. On the other hand, if you and the ex are able to agree the division, and it doesn't look too unusual, courts generally wouldn't stop it.
