Ex partner wants me to sell family home

Hi, I am very new to this but really hoping for some advise from someone who has maybe been in a similar situation.

So basically my ex partner and I separated in 2013. We have two children together now 8 and 9 years old.

When we separated in 2013 I was unable to take the house on myself as I was only working part time. I was able to pay the mortgage still using my child tax credit ect so I went to a solicitor who advised me that he couldn't make me sell until our youngest was 18. He hasn't paid a penny towards the mortgage since he moved out but does pay child maintenance. I also informed my mortgage company that he had moved out and wasn't paying anything.

My new partner moved in nearly 2 years ago and has been paying the mortgage with me since. My ex has now decided that he wants me to sell or give him half the equity in the house which is just over £20000. I feel this is very unfair and have offered him more than I feel he is welcome to but he refuses anything below the £20000 and now wants to take me to court :(.

Will the court give him half the equity even though he hasn't paid anything for so many years. I have proof that I have paid it on my own without him.

Any advice is much appreciated.

Assuming you're in England and Wales...

If you have reduced the mortgage since he left you should get credit for that but otherwise yes he is entitled to half on what you have said.

You may be able to make him wait until kids are 18 but more complicated now you have a boyfriend living there.

Seek legal advice, this is an overview based on very low information.
