Occupation order

Has anyone been granted an occupation order on the basis of stress caused by ex, to me and children? That him continued to live here would interfere with my health to the extent of endangering the children? And emotional abuse of them?

Hi there

My solicitor discussed that with me as my husband who wanted to be with other woman, wanted to continue living in the house and working in the office (in the garden) , In the end she issues him with a letter stating she would apply for a occupation order and i think a restraining order if he didn't leave the house by a certain date. This avoided it going to court. He was an ass about it but he did leave a few hours later.

I then changed the locks and kept the gate locked to deter him from coming back.

Well done that's amazing ! I am looking at mine on the grounds of verbally bullying and he pushed my mum! I have 5 children and he would like me out of the house so my solicitor strongly suggested we do this. What a nightmare x

Yes that was the grounds that my solicitor got him removed. He was causing me to have mental health problems by remaining and by his behaviour in general, he couldn't see it and still can't!! He's also receive entered the garden and she's since, which he wouldn't have been able to do if I had actually got the order put on him. In hign sight I wish I had got the order as I lived in fear does months that he would come back again! I have 2 very young children that I constantly felt like I was and still am trying to protect. What was the outcome? Were you granted the Order? I'm in a very similar situation.

I've been recommended the solicitors letter threatening an order first, I'm tempted to say "have you met my ex" as I don't think he'll go until there's a bailiff or policemen standing waiting for him to leave

I can relate to that. The threat of it did nothing in my circumstance. I'm dealing with an equally stubborn character.
I've issued the order and had the first hearing at which he said he would contest it. He gets a certain number of days to do that. So currently I am waiting to see whether he will actually submit a defence.
I was interested to see how your situation developed given our circumstances seem similar in that there is no physical violence. I view the emotional abuse/bullying as just as harmful but wasn't sure a court would agree.

I'm at the same place I've got a new solicitor as the other was terrible and slow and I have a gp letter signed off I have a couple if police logs but I do feel.bad as I know he has no funds to go anywhere else and we do have the children half and half but I'm currently at my mum's house when I have the children and he ismy bothered it's a small house and I have 5 children x
