Financial Disclosure for court

Hello. STBXH & I have just exchanged Form E’s through lawyers. I don’t expect him to have been honest with this. I was wondering if God forbid, we do go to court, will they look at the bank statements & pay slips that we’ve just exchanged, or a new set from closer to the time?

I submitted mine and they looked at them. The case didn’t reach court for 15 months after, so they asked for a complete new set and looked at those as well.

In my experience when exam was questioned about inconsistencies - eg big withdrawals were just explained away as ‘holiday payments’ there was no real comeback from the solicitors, barrister or judge and he simply got away with it all. So if there is any chance to discussing with him directly and not via solicitors and I would really encourage it.

It’s not always possible though - I certainly couldn’t with my exH and so it ended up costing me a fortune.

Agree with Namechanger2015, in my experience it was a massive waste of time (and money to the solicitor to detail, exchange and question it) with things like him withdrawing large amounts of cash each week despite all likely day to day spending evidenced on his bank statements were glibly passed over. If neither of you have over £10000 in savings I don't think they're fussed, it will just be the property that gets divided.
