Contesting and surname

If the respondent contests, what happens next? If it goes to a judge then who pays the further costs?
In regards to your married surname, do you have to go back to your maiden name? Can you legally still use your married name? I ask this in relation to the appeal to keep the married surname as it's my children's surname.
I've heard of deed poll but not a clue with that and so asking here if anyone can give advice, thankyou.

I assume you are in England /Wales?

If so, you can continue to use your married name as long as you like. No formalities necessary.

If someone contests a petition the judge decides who pays. I would expect the successful party to have their costs paid by the other side but it isn't inevitable. You have to pay your own costs in the first place.

Your last question doesn't make sense.
