Delaying decree absolute

youareallbonkers · 14/04/2015 12:34

The decree nisi has just been granted but financial side hasn't been resolved yet. How do I ask the court not to grant the absolute? Do I just write? What do I say? Many thanks

I don't think they would grant a decree absolute without financial side being resolved? There is usually quite a time between Nisi & Absolute.
Did you have a consent order with the divorce petition re finances?

Lonecatwithkitten · 14/04/2015 12:37

You just don't apply for it. I have had DN for 19 months, but Ex is dragging his heels massively over finances so I haven't applied.
This assumes you are the petitioner.

youareallbonkers · 14/04/2015 12:39

I am the respondent. Husband thinks finances sorted so a Court would nit know there is an issue

You can't stop it as the respondent but if you are in the court process for finances, you can ask him to agree to undertakings to not apply. That's what I had to do.

We are just at mediation stage but he won't agree as wants to remarry and that will complicate things

You have to make an application to court to put a hold on DA in case your ex applies for it. Use form D11. Info on fees is in form EX50.

I don't know how much his pension is. He's 54 and has worked since leaving school so has a decent amount
