We are likely to divorce, I am breadwinner and pay for all house expenses.i work full time but he only works 3 days a week. Does anyone have any experience of trying to get the major share of custody of children. How did you go about it. I want then to remain in family home, still attend the same schools. The courts seem awefuly in favour of non working mums and dads but my argument is that he cannot afford to have then half the time as he is teaching

What's their current routine?

Are you in any way the primary caregiver despite him only working three days pw?

If you can show that, even with you working full time, it's you that provides the majority of care for the children then you're more likely to continue this arrangement post-separation.

If however he currently does school runs, makes dinner, does the majority of their care during the week ...then you'd be lucky to get a 50/50 shared care arrangement.

it is not 'custody' as they are not criminals being detained. I think the preferred term is 'residence' and in general i imagine if they can stay where they are and continue at the same school then that would be for the best, as would having a main residence and visits rather than 50'50 - but this is only based on hearsay and anecdote - surely you would be better off asking a family lawyer?

Who is leaving who? I generally err on the opinion that the one who wants to leave goes. The children and the other parent remain in the home.
