Its coming up for a year since stbxh and I separated. It's taken a while but we have settled on consistent contact regarding children, maintanence and we have no assets to divide.

Would I be right in thinking we should be able to go for an undefended divorce? Also what is the cost for a divorce? I work 24 hours a week, annual income from it being £7400. Do they take into account benefit income when deciding if you qualify for legal aid?

You'd need to be seperated 2 years for a no fault divorce, which will be easier all round.

Benefit income is taken into account...do you qualify for Housing Benefit or Local Housing Allowance? If so, am fairly sure that means you qualify for Legal Aid (or whatever it's called now). If not, check direct gov as there's a link to calculator from there.

Are the rules different in Scotland? I thought it was one year but not certain. I qualify for some housing benefit but I have two lodgers so don't recieve a huge deal.

You need to be seperated for 2 years for a no fault divorce. I work part time and claim working tax credits. They take this into account and my benefits take me over the threshold for legal aid! I can't afford to get divorced! WTF!!
