CMS paternity

My ex partner is about to go on paternity leave for 6 months with his baby with his new partner. Should I expect my CMS payments from him to be reduced as he will be getting statutory pay

You’ll need to find out what he’s actually going to get paid because he isn’t getting statutory pay for 6 months.

Statutory paternity is 2 weeks and beyond that if his partner is also off for 6 months then he won’t be entitled to any of that statutory maternity pay. I would assume his workplace offers a good paternity package but he’s not getting 6 months of statutory.

If his pay goes down though then yes CMS will go down.

Him and his partner are doing shared maternity leave so she has had 6 months and returning to work and he will be taking 6 months too

There is only 39 weeks of SMP. If she is taking 6 months that only leaves 13 weeks of statutory pay that he can take so he could not have 6 months.

Tbh I'd be budgeting for getting nothing.

If he's getting 13 weeks of SMP rate and then potentially taking the unpaid part he's likely to get a zero aware from CMS for a while.

Friends who did this paid his CMS as normal through the whole period regardless if who was off, but I think their way of dealing with this is very much in a minority.

The new baby will reduce his regular CMS rate (assuming he pays only the mandatory rate) once he's back working too.
