Can you be on tenancy agreement and still be non dependant? Disabled dd, UC PLEASE HELP

dd recently became disabled and lost her job.

family member and I on low income, we get uc

universal credit splits rent into 3

someone advised us to change daughter to as non dependant as she doesn’t pay rent. So I’d be split into 2 and not 3

but she is on the tenancy agreement?

they said it doesn’t matter if she is, she can be on tenancy agreement and still be considered non dependant. We just have to explain to uc

is this true? Can anyone advise?

I thought non dependent meant they are not financially dependent on you? Surely she isn't on your UC claim as a dependent anyway if she has been working? Or is she very young still?

Actually if she is on the tenancy agreement she cannot be a dependant, she would have to be 18, and presumably not in education as was working.

No it means adult family member who is living with you but not paying rent or financially contributing

that’s what they told us

What’s weird is 5 years ago when she was 23 I found old paperwork when I was claiming that she was considered a non dependant

even though she was on the tenancy agreement

I never said she was a dependant. She is over 18, how could she be?

she currently is listed as joint tenant and expected to pay her rent. I pay her share of rent, so I’m wondering if I should just change her to non dependant instead?

Is she claiming UC and/or New style ESA in her own name? If not she should be then she will be able to contribute to the rent herself. Has she put in a claim for PIP? At 28 she is not a dependent. If she's disabled surely she gets disability money and should be contributing from that. If you give false information like saying she is a dependent you could be penalised by sanctions by UC. For goodness sake update your claim to show she is non dependent.

You would still have a non dependent deduction ( around £90 ) on your rent element if you put her down as a non dependent unless she gets PIP.
Is it private rent or council ? I can possibly see the advantage of her being on the tenancy if it's council and she one day might want to suceed the tenancy.
Is she claiming UC herself ? if so then she will surely be getting a rent element on her own claim?

That would still be way less than what I pay now. Currently they split rent into 3

its private rent

she is not currently claiming uc. She is not getting any benefits or working

A non dependent just means she's not a dependent as in not part of your claim. She's just another person who lives in your house.

Yeah I was just wondering am I allowed to change to that? If she is in the tenancy agreement

some said no, because she is on tenancy agreement, others said yes, just call them and explain
