PIP & Universal credit

Hi there my partner currently receives PIP and is thinking of moving in with me. If he does I will need to add him to my universal credit claim. I was wondering if we did this would it trigger a pip review (it's not due for another 2 years). He suffers badly with his mental health so if it would trigger another assessment we wouldn't want to move in as he couldn't cope with this mentally. Any advice would be great

He will need to claim UC and you'll need to got through the rigmarole of linking codes etc but it shouldn't trigger a PIP review as they're two separate benefits.

Is he on legacy benefits such as ESA at the moment?

Hi yes he does get ESA will that automatically be transferred to UC aswell or will he need to do another assessment for that? Thanks

@eastview if he's in the Support Group in ESA then that will mean he is treated as having Limited Capability for Work Related Activity (LCfWRA) in UC. The LCfWRA element in UC is worth a bit more in cash terms than in IR ESA.

However if you also have LCfWRA then you can only have one LCfWRA element in a joint claim.

Thank you he is in the support group. So this would just automatically transfer over to LCWRA without an additional assessment? I don't claim LCW or LCWRA so that's absolutely fine. Thanks for your help

@eastview it should be automatic as it's set out in the UC Regs 2013. As well as the money there are implications for the terms of the Claimant Commitment and Work Related Requirements.

Some DWP staff, particularly Job Coaches at JC+, are not well informed on this stuff and ask people migrating to UC to agree inappropriate Work Related Requirements/Commitments.

If that happens come back for more advice.
