Split from husband - unsure how to continue Private Rentinf

Hiya,

My husband & I have recently decided to separate, we have 2 kids & currently privately rent a house. I’d like to stay in the house as there’s already a lot of change going on & want some consistency for the kids.

i spoke to the estate agents who said, as I don’t meet the earnings criteria on my own (about 5k out), I need a letter from Universal Credit stating what I will be entitled to with my husband off the Claim. As we do currently have an open claim with Universal Credit I’m not sure how to go about this, I contacted them a week ago to request the information which they haven’t responded to (surprise!). Has anyone had much luck with receiving a letter like this? I’ve never heard of them providing this & not sure if they’ll supply what I need.

any advice or previous experiences would be appreciated!

If you have a current claim are you actually being paid and when does your Assessment Period end?

Has your husband moved out and have you done the change of circs thing with UC?

I'm not sure that UC will give you a figure; they're reluctant to do so as so many variables can affect a claim. You should though be able to get an estimate from one of the online tools like turn2us or entitledto.

Yeah I’m being paid, but the amount I’m currently being paid would leave me about 1k out of passing the earnings assessment.
I haven’t done change of circ yet because I assumed they were going to request a new rental agreement, which I won’t have for what feels like an eternity.
Life done the EntitledTo calc & they’ve said they can’t accept that (obviously🙄)

feels like I’m stuck between a rock & hard place!

They will still pay you exactly the same UC rent element that they pay you now , it's just the the total amount you will receive will rise as you'll have less deductions for earnings. Also I presume your ex will be paying child maintenance - would they consider that too? As above DWP won't be able to tell you the exact amount of UC you will receive as they can't calculate that until the end of each assessment period but they can clarify the rent element paid before deductions. can't you show them a current statement and explain that the actual rent element won't change.

Also you don't necessarily need a new tenancy agreement but you would need to let UC know what is happening - it can be considered am 'untidy tenancy' until your partner is removed, that way you should still continue to get full rent element rather than just half of it.

I was waiting for confirmation that husband had moved out but was going to make the same untidy tenancy point as @Miley1967.

If you're paying the rent month by month then I don't think they'd move to end the tenancy even if the ex was still on it.

I updated the Universal Credit today, however now I’m very on edge as it’s only given me 10 days to supply a new rental agreement.

I won’t have my housing paid unless I can supply this, which means I’ll be out of money quite a substantial amount. What happens if i can’t get the agreement in time?

Get on to EA/LL and ask for a new tenancy agreement in order to get rent elements of UC paid. Tell them without it rent might be delayed. I'm a LL and I'd do it immediately for you.

I ended up being lucky that the amounts I was receiving from UC already took me to the amount I needed to earn to pass eligibility on my new rental agreement.

UC however did then not pay me for a month because the crossover between “tenancy’s”. I’m currently arguing with them about this, so if anyone knows how to make an actual complain to them that would be great haha.
