Mot failed. Do I need to SORN?

Hi
Car has failed MOT
Garage can't fit it in until 18 June
Do I REALLY need to SORN
Website currently says SORN taking 2 weeks to process by which time it'll be MOT,d again

Presumably it is already tax & insured, these will continue until the garage sorts it next week, and then hopefully it passes its MOT.

I've been told DVLA cancel tax once MOT has failed
I've tried to phone them and ask them not to cancel tax, but can't get through on phone

Will it be parked on the road in this time? If can find a driveway or somewhere doesn't need to be SORN. I thought the declaration was fairly instant though, so not sure why would take 2 weeks. I thought just got an automated e-Mail. What would be benefit of doing it though?

I've not heard of that personally.

You can't tax it without a valid MOT, and if it fails an MOT you can chose to cancel the tax and apply for a refund of the remaining amount.

But what would the point of SORNing, them re taxing a week or so later (not to mention that you'd end up paying the tax for June twice).

The garage I use, and the garage my DP (MOT tester & mechanic) works for, are both booking about 3 weeks ahead atm.
Whilst I'd want my car fixed quicker, I wouldn't be surprised that they couldn't fit it in.

What date was your MOT valid until, because if you have booked it in early you technically still have a valid MOT certificate. If the MOT date has already passed, you are only allowed to drive the car to the garage to be fixed, you cannot drive it anywhere else. You definitely do not need to SORN it.

It has to be parked up on a private driveway or in a garage, the insurance invalidates with a failed mot (except whilst parked in the safe space). The insurance only covers you to the mot garage with a prebooked appointment. Just been through this myself and my dad works for insurance so I've had the speech given just this week lol 😆

Has the MOT actually expired?

If it has, I would keep it off the road but not cancel the tax. Admittedly its been a while since I was in a similar situation, but the road tax wasn’t cancelled because my car had failed, but maybe it’s different nowadays. You’d need tax to drive it to the garage for repairs, so if you cancel it you’d have to pay twice for June?

This is probably extremely unhelpful, but you can book the mot up to a month before it expires - might help for next year.

It's fine on your drive, as long as it's off the road. You'll be covered to drive it back to the garage for the repair appointment.

Sometimes garages will keep vehicles in, sometimes they won't. If you'd had told them you had nowhere to store it off the road, I imagine they'd tuck it somewhere at the garage for you.

Honestly, nothing to worry about. This kind of thing happens all the time.

The DVLA will not cancel your tax due to the MOT failure.
(You do have the option of cancelling the tax yourself if it will be off road for long enough to make that worthwhile)

Assuming it is currently taxed, and also insured then there is no need to submit a SORN

If you suspend your insurance or the tax has expired then you should SORN

Your driveway is fine (it’s off the road)
Just ensure that if you drive back to the garage that you have details of the booking to cover you for lack of MOT

On failure a garage would normally inform you if the vehicle is of such a state that it must not be driven even with a booking - but it’s down to you, so check the failure points, which can be verified online

The DVLA did cancel my tax once, so it always freaks me out!! (Something to do with transferring log book to my then husband 🙄)
I miss the days of taxing a car and it staying taxed!

That was a ‘new’ change since 2014
On change of ownership tax is cancelled, with the previous owner getting refunded for any remaining full months.

Under the old system, some sellers would cash in and some would hand it over. This was useful for a part month remaining.

I was caught out in my younger days with a sale/purchase. Both cars were taxed, we agreed on the price and when I drove off I didn’t have tax ….. and I also saw him driving around in my old car with no tax. He had sent them both off for refunds

Yes, if you transfer the registered ownership then the tax is cancelled and the new owner has to retax it.
(As you say, it used to just stay taxed when sold).

Hope the thread has relieved your concerns and it's fixed quickly once it goes back to the garage.

Crikey is it really 10 years since they changed rules!!
You'd have thought I'd have figured out what to do by now! 🙄
I guess it's only come up because usually the garage does the repair in a day or so
