If you receive LCWRA will you be entitled to the COL payment

No one just receives LCWRA alone, it is one element of a Universal credit claim ( unless it is contributions based ESA you receive). So yes if you claim Universal credit and you had a UC claim during the qualifying period of 18/8/23 and 17/9/23, you will be eligible to get the COL payment.

Hi,
I am looking for some help/answers regarding LCWRA.

I had a WCA arranged through ESA on 20th September with a doctor over the phone. After a few days I found out that they recommended that I have met the criteria for LCWRA. However, ESA said that although the notes says so, it still needed a decision maker to approve the doctor's recommendation which I understand. The concern I have is if the decision maker approves the LCWRA will I have a backpayment? I started handing in fit notes to ESA on 06Sep22 then had a WCA in April 2023 which said I did not meet the criteria for LCWRA, I did an MR with an additional change in circumstances which the they reviewed and then give me a backpayment for the period I stopped receiving ESA as well as continued paying me ESA which stopped on 5sep2023 because I met the maximum 365 days for ESA. If I was to get a backpayment when will this start from will it be from January 2023 or none as they started paying me after the MR in June 2023? Also, I do get UC and have been told that I will also receive an LCWRA payment of £390 each month after the decision maker approves my WCA outcome. Will I get a backpayment from UC? I started handing them sick notes since February 2022 as I had a terrible accident that has made it impossible for me to work and still actively having treatments. I did have an assessment with UC in August 2022 over the phone but they found that I was capable of working and did not take everything into account. I did an MR but they still upheld their decision. I continued to hand in sicknotes as I still was not able to work in my condition. Will they backdate the uc lcwra element as a result?

If I understand your post correctly, you applied for ESA in sept 2022 and were assessed in April 2023. You were found either fit for work or to have lcw at that assessment. You appealed that decision and were found to have lcwra. You have since had a further assessment which found you to have lcwra.

A few things seem wrong here. ESA only stops after a year if you're in the lcw group. If you were lcwra, your ESA should not have stopped. Did you perhaps make a mistake in your op?

It's impossible to say if you'll get backdated payments without going through your UC journal and any paperwork about your ESA. You might be best going to an advice service where someone can look over everything with you

I applied and was accepted and received about 3/4months in back pay. (From the time I had started providing fit notes).

I did have to chase them though they never told me I was owed anything.

Hi thanks for your response, yes the MR allowed me to continue with ESA until the end of year period which was sep23.
