Hey ladies

I'm in a right pickle

I've applied to rent somewhere

And found out I've got a ccj! I am so angry as it's not even a large amount of money but I wasn't made aware and didn't get chance to even pay it!

Who do I pay please is it the company who took the credit card off the company like the debt company or do I pay the court?

I don't even really understand what a ccj is tbh I always thought you had to actually go to court so I'm clueless

Please help ladies

This happened to my sister when she applied for a mortgage. Found out she had a CCJ she never knew about for a parking ticket she never received.

It did get sorted. I think the CCJ is on her record but the bank took her explanation and said it happens more than people think. Try not to stress too much about it. My sister thought it would mean she couldn't get a mortgage but she's just bought her second house now! 😅

Do you accept you had and used the card mentioned and that, for whatever reason you owe the money?

Process wise the usual thing is for the Claimant, the person or outfit asserting they're owed money, to apply to the court for what we used to call a default summons. I think the terminology has changed since then but the principle is similar.

They will give the court your address and the court will send you details of the claim by post. You have a period of time in which to admit, the debt, defend it etc.

If you fail to respond the claimant can enter judgment by default and, should they wish, enforce it by sending a bailiff around or by getting a deduction from earnings or benefits. i suspect that is what has happened here and either the court paperwork went to an old address and not returned or was otherwise missed.

If there is a dispute about what is owed and/or you have reason to question something you can ask for the judgement to be set aside. There will be a fee to pay for that and you may have a hearing though I suspect it'd be decided on the papers.

Plenty of advice on various websites including that of the Court Service.

One word of caution. If you find some outfit offering to clean youe record for a fee avoid like the plague - that way lies potential trouble as all to often they're fast/lose with the truth...

If there was an admin error which means you didn’t receive the papers, you can apply to get the judgement set aside, eg if you notified the creditor of a move of address and they didn’t update their records. Google how to get judgements set aside to see if that is an option as it Will completely remove the cjp from your record. Paying it off will not get the check removed but it will be marked as satisfied.

I think if it's set aside you can contact the credit check agencies 'experian' etc and get a note added to your records.

PLEASE double check this on Money Saving Expert or somewhere similar as I'm not 100% sure of the details but am fairly sure it's a thing

If the only address the creditor has is one you've left and you didn't tell them you were moving how else are they going to proceed if you've not paid?

If stuff addressed to a previous occupier was coming through my letterbox more than a few months after they'd left I'd mark it 'gone away' and send it back to the return address. But if the old address was an HMO or a place with multiple converted flats an on external box I guess it just piles up on the door mat.

Hi @frogprin1 what debt is the CCJ relating to?

We've recently had one overturned on the basis that we were 'there to be found' (as our correct address was on the electoral role, utility companies etc...). Had you updated all these details when you moved? As others have said above, we had to submit an N244 to the court, which is an application to set aside. It is a fairly long process though. It is worth doing if you think you have a strong case, as it is fully wiped from your record rather than marked as 'satisfied' (which is what happens when you pay it).

Money Saving Expert is the best place to search. Our was related to a parking ticket, but I'm sure there are other threads in the forum relating to other types of debt.

I’ve asked about something similar but not really sure what to do with this aspect.
my ex husband has applied CMS to pay maintenance as a way to overturn our consent order. This is a couple of years old and he is in breach for never increasing payments in line with RPI. Have sent him a breakdown but no reply.
Now he’s been made redundant. Is there any point filing a d11 to enforce? I feel I don’t have any choice but to continue the CMS application.
