Universal credit - leaving husband - options

I have used entitledto benefits calculator to look at options. If I rent, I am intitled to 200 per week but when we sell the house and I buy my own, I am entitled to nothing. Does that sound right? Can someone please explain?

£200 per week seems a lot, I work full time and earn a decent amount. How can I be sure this amount is correct?

So the way it works is if your currently living in a mortgage property they don't pay the "housing element" so if your in rented or social/HA they will pay. Once you sell your house you have up to 6-12 month to either buy a new home, then after that period the equity will be used as your savings a deduction will happen from 6k-16k after 16k you won't be able to claim UC
If you re buy! You won't getting housing but will get "personal elements" children if you have them, then deduct your wages if you work! x

The government doesn't pay people's mortgages because your mortgage payments go towards a financial asset. Rent is obviously a different matter.

NCSJ18 · 15/11/2020 10:18

Also if you do have children you would get a work allowance of £512 which means how much you can earn before deductions from you UC happens. Based on no housing element so if you get say 1000 off then but work and earn £800 they'll deduct a smaller amount so will be better off so like
800-512= 288 then 288x0.63 =181 so you'll get £818 in IC and 800 in wages x

Thanks guys. Makes more sense now. I was worried about renting but this will really help my finances, so I can concentrate on the kids.

Yeh it's stressful trying to figure it all out and it's very confusiing Good luck with your future wish you all the best x

If you jointly own a house with your ex then Uc will disregard the capital in that house if reasonable measures are being taken to sell it and they will help you with the rent element in the meantime if oyu need to rent somewhere to live. However if you eventually gain more than 16k from the sale of that property or when your ex buys you out of it, you will not be entitled to Uc until your capital drops below 16k

How long will they help for? I read somewhere its 6 months but my husband is refusing to sell and he can't remortgage to buy me out for 3 years.

Can you get a court order to force a sale?

I earn enough to not be entitled to legal aid and from what I can gather from MN posts ot could cost thousands, which I dont have.

Has anyone been in this situation? I had a appointment with uc and they said they would help with rent and the fact I own a house won't matter if I'm not living in it, it won't be a part of the application? I don't know if thats right and I dont know who else to ask. Uc said they won't know until I update my details when I move into rented house. I need to know if I can afford to rent first and I dont think I can without uc.

Caculate you LHA google it, it's should be a orange and white website type in your details IE ideal area how many kids adults etc and it will tell you how much your entitled to a week then you times it by 52 and divide by 12 an that's how much UC will pay you per month for your rent xx
madcatladyforever · 12/12/2020 09:25

I'm shocked that you cannot get a legal aid court order to force him to sell. When I got divorced in the early 90's legal aid covered everything thank God or I would have been out on the street without my son.
It really puts women with abusive husbands who refuse to sell or co-operate in any way in a terrible and dangerous position. Protection for women is almost non existent now.

I'm not 100% sure I can't remember but think the application form asks about capital which includes capital of a property you own but don't live (minus 10%). But this is disregarded for a period if you are taking steps to sell it.

There's a good group on Facebook called universal credit essentials. There's lots of good knowledge on there.

Tulip55 · 12/12/2020 09:36

I cant join any groups on fb as my stbxh will know about it then. I dont want him to know.

Unless stbx has your password and logs into your account, others cannot see private groups you are part of in FB

Tulip55 · 12/12/2020 09:58

I just went on a googling mission and found my answer on entitledto website...
