Work refusing to pay me...

shannonhinton0421 · 24/01/2022 14:40

Last week I had to take a day off work as my fiancé who's a nurse done a lateral flow test and it came back positive, we had to wait until the next day for her PCR results to come back, thankfully they came back negative.
I have only had 1 vaccine for personal reasons. My work advised I couldn't go into work until she received her results and came back negative but have refused to pay me.
Are they aloud to refuse to pay me for this?

It depends on the type of contract you have

Wreath21 · 24/01/2022 14:43

It depends on your contract - do you get sick pay or paid leave, or are you a casual worker, paid only for the hours you work?
Or has your employer introduced and informed you of new regulations regarding vaccination status?

MrsJaxTellerPlease · 24/01/2022 14:43

Yes they can.

GirlInACountrySong · 24/01/2022 14:46

course they can

personal reasons rather than medically based?

you put extra strain on colleagues picking up the slack as well.

More and more companies are doing this - IKEA for one - off the top of my head. Unless medical exemption for vaccine then by choosing to not be fully vaccinated you are choosing to be off work. I believe you can still claim SSP for isolation days. Just no get full pay!

Given that (if England) you don't have to isolate (are you jabbed?) I wouldnt even have informed them and just gone to work.

GirlInACountrySong · 24/01/2022 14:50

could you ask them to change it to a days annual leave

I would do this for my staff

CorrBlimeyGG · 24/01/2022 14:51

@BernadetteRostankowskiWolowitz Did you even read the opening post?

Sirzy · 24/01/2022 14:53

If you had been vaccinated you could have gone in therefore it’s your choice not to vaccinate which meant you couldn’t work so not being paid is fair enough

HermioneWeasley · 24/01/2022 14:54

Yes they can - you weren’t sick, if you’d been vaccinated you would have been able to work

RestingPandaFace · 24/01/2022 14:54

You weren’t sick.
You weren’t instructed by T&T to isolate. You’ve chosen not to be fully vaccinated which would have allowed you to attend work as normal.

As far as work is concerned you had a totally avoidable day off as a result of your choices. Why would they pay you?

Wellbythebloodyhell · 24/01/2022 15:09

Of course they don't have to pay you, but it does highlight why many people don't bother testing or isolating anymore . Vaccinated or not at many workplaces you wouldn't have been paid for taking a day off regardless of the reason

LidlMiddleLover · 24/01/2022 15:21

I think they are within their rights as your personal choice to put yourself in this situation meant others covering for you

I'd probably ask for this thread to be deleted now OP as you have your answer.

Otherwise its just going to be post after post of people who haven't read the thread responding (with various levels of politeness!)

Lindy2 · 24/01/2022 16:25

You wouldn't have needed to isolate if you were properly vaccinated. You may choose to remain unvaccinated but you can't expect that choice to be funded for you.

If you choose to çontinue not be vaccinated you'll need to get used to things like this.

Buzzinwithbez · 24/01/2022 17:32

I'm sorry to hear are this, op. From March it's possible that they won't even be asking people who test positive to isolate, so it's unlikely to be a long term thing. Flowers

QuestionsorComments · 24/01/2022 17:34

They don't need to pay yoou no. Isolation depends why you aren't vaccinated. If it's for medical reasons you don't need to isolate (too late now)

gettingolderandgrumpy · 24/01/2022 18:04

No they don’t , can you ask if you can take it as annual leave ? .
