Dp staff member not self isolated for 10 days

Dp is a manager. One of his staff text in Sunday night and said that his son has tested positive so he won't be in to work.

Dp has told me the staff member is coming back tomorrow so has been off for 2 days in total.

Dp has had both jabs. I've had the 2nd one today.

My mother is very mentally ill and mid seventies. She has refused to have the jab.

I saw her today and would normally see her again next Tuesday. Now I'm worried about giving her covid.

Opinions please?

Ps. DP WIll not make his staff member stay home so that's not an option.

Why won’t he make him stay at home? Tell him to grow a backbone, start managing if he’s the manager and say no!

He needs to stay at home and as his manager your DP needs to enforce this as he has a duty of care to other staff.

When did his sons symptoms start? Your dh needs to see evidence from test & trace of when his isolation ends.

If you are certain that he should still be isolating you can report him. Employers must not knowingly allow an employee who should be self isolating into work.

Well DP will have to make his staff member stay at home there literally isn't any other option.

“ It is an offence for you (as an employer) to allow a worker to attend the workplace if you are aware that the worker:

has tested positive for COVID-19
has been in close contact with someone who has tested positive and they have received a notification to self-isolate from NHS Test and Trace
This NHS guidance sets out how long an individual must self-isolate for.

If you know that a worker has been told to self-isolate by NHS Test and Trace, it is your legal duty to not allow them to come into work or work anywhere other than where they are self-isolating (usually, their home) for their full self-isolation period. Failure to do so could result in your firm facing a fine, starting from £1,000.”

If he'd received one of the daft notification things I'd understand but he is living with someone with covid. The staff member needs to stop at home

Why does your manger want a person who is high risk in his work place to spreed it around. This isn't just a ping from being in the same restaurant, he lives with him. With the delta variant he is very likely to have it.

He knows this person is a very very close contact of a positive case and is knowingly allowing them to come back to work? Let's see how that goes if this guy tests positive and other staff have had to work with him.

When did the son test positive? Is it possible he had symptoms for a while before testing so has done the 10 days?

This. Your DP needs to stop the staff member coming in. Its the law.

TBH I'd be telling my DH he needs to sort the work situation out, or set up a space at the office for himself to sleep until the employee's son is better & it's certain that the employee hasn't caught it. He's deliberately risking bringing it home to you, ask him - doesn't he care?

He will have been officially told how long he was to isolate for. Why do you think you know better?

1- does he live with the son? (eg entirely possible he sees him EOW, got the notification on day 7?)
2- Legally, when does his SI end?

If he is still meant to be SI, your DP needs to tell him not to come in and escalate it upwards if he himself has a manager. No other option.

Or could it have a positive lateral flow followed by a negative PCR? It’s up to your husband to find out and tell him not to return until permitted

I've now spoken to him again and he says I got it wrong and it's actually next Tuesday he's coming back, which will be 10 days.

I did explain the situation to him regarding the company getting a fine and potentially I'm getting the sack! (I had already spelt out about spreading it to the whole workforce anyway)
