Test and Trace-is participating a legal requirement?

I have googled but not found the answer. Does anyone know if it is a legal requirement to provide Test and Trace with your contacts' names and contact details? (If you have a positive PCR test and you are contacted by T and T ).

"Share contacts: if you test positive for COVID-19, NHS Test and Trace will send you a text or email alert or call you with instructions of how to share details of people with whom you have had close, recent contact and places you have visited. It is important that you respond quickly and accurately so that we can give appropriate advice to those who need it. You will be told to do this online via a secure website or you will be called by one of our contract tracers. If NHS Test and Trace contact tracers are unable to contact you for 24 hours, they may pass your case to your local authority to follow up by phone or in person."

Yes it is a legal requirement.

Thanks. Yes I've seen that bit, but I was wondering where it says that it is actually a legal requirement and that by not giving them details of your contacts you are breaking the law.

Can you reference the relevant law on this please @Lougle? The statement you have posted does not cite it.

conkersarebonkers · 20/06/2021 12:26

I am not a lawyer but I can only see a bit about giving the details of other people in the household: www.legislation.gov.uk/uksi/2020/1045/regulation/2A

(2) Where paragraph (1)(a) applies, the person notified must—

(a)self-isolate for the period of self-isolation, and
(b)notify the relevant person of the name of each person living in the same household as P.

The Health Protection (Coronavirus, Collection of Contact Details etc and Related Requirements) Regulations 2020 seems to be about collecting details at business premises.

It’s a legal requirement to self isolate.
It is not a legal requirement to provide details of your contacts - but as they could be spreading COVID either symptomatically or asymptotically - why would you not?

Because I think it's a breach of privacy. I know who I have seen and can tell them myself.

If you’re happy to take the responsibility to tell them they legally have to self isolate that’s up to you i suppose - do you think they’d listen?

I personally don’t think giving someone’s name and number during a pandemic to try and do your bit to reduce the spread is an invasion of privacy - but I respect your opinion.

Roonerspismed · 20/06/2021 22:06

I don’t know but I’m at the point of thinking we should all give up

dementedpixie · 20/06/2021 22:08

But they may not be able to claim monetary support without proof of being told to isolate by T&T

DorotheaDiamond · 20/06/2021 22:08

Although they may need to officially be told by T&T if they want to claim on travel insurance if that was relevant!

LoopyGremlin · 20/06/2021 22:09

But if you tell them @Bitofachinwag then they won’t have anything official to show an employer that they must self isolate. If it is done through official channels then they will.

ineedaholidaynow · 20/06/2021 22:09

Their employer might want official proof if they need to isolate.

Bitofachinwag · 20/06/2021 22:19

OK, I see your points, I didn't know about needing official proof for your employer or being able to claim money. Thanks.

Our workplace only pay us for being off if we are contacted via Test & Trace

HalzTangz · 20/06/2021 22:54

So a breach of privacy is more important than them passing covid to potentially someone vunerable who could potentially die

JanFebAnyMonth · 20/06/2021 22:58

www.legislation.gov.uk/uksi/2020/1045/pdfs/uksi_20201045_en.pdf

Can’t see anything here about being legally required to give people’s contact details. However I saw an article saying you can be fined for falsely giving someone’s details (ie the opposite of what you’re asking).

But yes it will make it difficult for your close contacts if they’re not officially told to isolate.

Bitofachinwag · 20/06/2021 23:11

How have you drawn that conclusion from what I said?
