Tier 3 question

We are in a tier 3 area and have tickets booked at an outdoor attraction in another tier 3 area. I emailed them to ask about a refund or voucher as we will still be in tier 3 on the date of the event.

They have emailed back saying "if we do not wish to travel send details for a refund". Am I wrong in thinking we aren't allowed to visit under the current guidelines. It is something we would like to do and a one off event thing so not something we can re-book.

Per Tier 3 to tier 3 -"The government is advising against nearly all travel for those in tier 3 areas. “Avoid travelling to other parts of the UK, including for overnight stays other than where necessary".

If the venue is offering you a refund, take it.

Rebook after the vaccine.

You can go. You're "allowed" to travel to venues and amenities which are open.

As you've already had pointed out to you today! in your own area NOT outside your area for social things (exceptions for work/care/education).

I see a lot of argument on here about this. I think the truth is the guidance is ambiguous.

You can go if you want to, there is no law saying you cannot travel there. The guidance is just that, guidance. Designed to put people off travelling but not illegal or attracting a fine.

My understanding is that travel advice is guidance, not law.
You can still go if you want to and take appropriate steps to keep safe.

Personally unless it was a once in a lifetime event that I'd forever regret missing I wouldn't want to travel in the current climate as there's additional risk with using facilities, service stations etc.

Right, so surely it'll be rescheduled? If the venue or artist has decided to not reschedule after the vaccines are rolled out, more fool them.

The answer to your question though is, no, you shouldn't go. The government has advised that you do not travel unless absolutely necessary.

Leisure and entertainment are not a necessity I am afraid.

You should take the refund you've been offered.

In tier 3:

●you must not meet socially indoors or in most outdoor places with anybody you do not live with, or who is not in your support bubble, this includes in any private garden or at most outdoor venues

●you must not socialise in a group of more than 6 in some other outdoor public spaces, including parks, beaches, countryside accessible to the public, a public garden, grounds of a heritage site or castle, or a sports facility – this is called the ‘rule of 6’

●hospitality settings, such as bars (including shisha venues), pubs, cafes and restaurants are closed – they are permitted to continue sales by takeaway, click-and-collect, drive-through or delivery services.

●accommodation such as hotels, B&Bs, campsites, and guest houses must close. There are several exemptions, such as for those who use these venues as their main residence, and those requiring the venues where it is reasonably necessary for work or education and training

●indoor entertainment and tourist venues must close. This includes:

-indoor play centres and areas, including trampolining parks and soft play

-casinos

-bingo halls

-bowling alleys

-skating rinks

-amusement arcades and adult gaming centres

-laser quests and escape rooms

-cinemas, theatres and concert halls

-snooker halls

●indoor attractions at mostly outdoor entertainment venues must also close (indoor shops, through-ways and public toilets at such attractions can remain open). This includes indoor attractions within:

-zoos, safari parks, and wildlife reserves

-aquariums, visitor attractions at farms, and other animal attractions

-model villages

-museums, galleries and sculpture parks

-botanical gardens, biomes or greenhouses

-theme parks, circuses, fairgrounds and funfairs

-visitor attractions at film studios, heritage sites such as castles and stately homes

-landmarks including observation decks and viewing platforms

-leisure and sports facilities may continue to stay open, but group exercise classes (including fitness and dance) should not go ahead. Saunas and steam rooms should close

●●●there should be no public attendance at spectator sport or indoor performances and large business events should not be taking place. Elite sport events may continue to take place without spectators

●●●large outdoor events (performances and shows) should not take place, with the exception of drive-in events

-places of worship remain open, but you must not attend with or socialise with anyone outside of your household or support bubble while you are there, unless a legal exemption applies

-weddings and funerals can go ahead with restrictions on the number of attendees – 15 people can attend wedding ceremonies, wedding receptions are not allowed, 30 people can attend funeral ceremonies, 15 people can attend linked commemorative events

-organised outdoor sport, and physical activity and exercise classes can continue, however higher-risk contact activity should not take place

-organised indoor sport, physical activity and exercise classes cannot take place indoors. There are exceptions for indoor disability sport, sport for educational purposes and supervised sport and physical activity for under-18s.

Not aside an area is advised. As we've established already there are no laws against travel in England, just advice. People are very keen to trot out "take your tier with you" so what logical reason should prevent OP leaving her tier 3 area to travel to an outdoor attraction in another tier 3 area? Made up special MN rules? Common sense would say it's perfectly fine. I would choose common sense.

TBH OP I don't see the issue. You asked for a refund and they're giving it to you.

Thank you for your replies. I just want to do the right thing.

To me it's not clear either way and I can't see it being rescheduled because of people in the area that can definitely go. It's not a once in a lifetime thing but is a seasonal thing. Maybe they will repeat it next year.

I have emailed the venue to ask them to clarify. It's only in the next county so we wouldn't be travelling far but none the less we don't want to go against the guidelines.

If they come back and tell us we shouldn't travel there then we won't.

OP we are in a tier 3 area and going to an outdoor event as a family in a neighbouring tier 3 county next weekend. It is low risk and won’t be near anyone. The madness of multiple households mixing for almost a week over Christmas in unventilated houses with no distancing will be responsible for the massive increase of deaths in January, not me taking my kids ice skating! I would go if I were you there’s very very little to look forward to in tier 3!!

We are in the same situation booked a Christmas event in another area which is tier 3. We’re also in tier 3 and still intend to go, never actually crossed my mind this wouldn’t be allowed and think the kids have missed out on enough already this year without us cancelling our Christmas day out.

I thought you can travel to venues that are open and also in tier 3, you are permitted to travel through a lower tier if it’s on route.

well you probably shouldn't go but when I was in tier 3 (pre-lockdown) we had a booked halloween event in tier 2. I emailed to ask if I could get a refund and they said no. They weren't remotely bothered we were coming from tier 3 (it was outdoors only if that makes a difference). So I have to admit we went anyway.

I am now wondering about my booked Father Christmas just over the border in tier 2. I am reasonably ok about getting my money back but if I don't I suspect I will go anyway.

The police came, then more police and they were.. not impressed to say the least i was eavesdropping
They came within 15 mins of the music starting and had it all cleared away within 30 mins

you've just reminded me. we're tier 3 as well and met up with 3 other families in the park yesterday. Oops - had genuinely forgotten we were not supposed to do this. We did arrange to meet but could just have easily have bumped into each other. Kids are seeing each other at school anyway so meh.

Exactly how easy it is. Go for a walk in park as family plus dog. Bump into two families of 4. Kids run off to play. 6 adults chat at 2am. Kids are school mates but different bubbles. Within 5 mins it's all gone pear shaped
