Can my son visit us?

DS was planning to come "home" to celebrate his birthday next weekend. The area he lives in will become Tier 2 tomorrow, we live in a Tier 1 - Medium risk area. Can he still come and stay for the weekend?
I've been trying to find out this morning. The Daily Mail says "no" and that you have to stay within the requirements for your own tier if you go to a lower ranked tier. I have read the restrictions on the government web site and I can't find that it says that at all. I will be so upset if we can't be together in some way, can anyone refer me to any official guidance and let me know if this is legally binding or just a recommendation. Thank you.

The relevant bit is : If you live in a high alert level area you also cannot meet indoors with people outside of the area, unless exceptions apply.

You are, however, fine to meet outdoors.

If he lives alone, and you are not in a support bubble with anyone else, then you can form a support bubble with him. This would mean he can visit.

Otherwise you can only meet outside.

No, unless he is in a support bubble with you then he can come and visit you.

I understand now, I had been reading it as if it applied to the area, rather than the people who live in it. Fortunately his actual birthday is today, so he can have his dinner party for 6 in total at his flat tonight, though it will have to wind up by midnight. If we have a run of good weather this week we might be able to meet up outside somewhere next Saturday just to hand over his presents.
