Notice Pay if on furlough

Does anyone from an HR background know whether, if I hand my notice into my employer, they have to pay me my full pay rate, or whether I would only receive the amount I'm receiving on furlough (75% of my usual salary) for my notice pay?
My notice period is 3 months and I'm on furlough until the end of September.

I am interviewing for a role I really want so just trying to understand the position if I were to be offered the role.

They do not have to pay you your full rate unless they actually require you to work.

However at the moment you should be getting 80% of your salary, not 75% (unless you are talking about discretionary bonuses etc)

Thanks for your reply, I couldn't find the answer anywhere online.
I'm getting 75% of my normal salary on furlough as the government 80% rate is only up to £2.5k pcm and my salary is above this. So my work are topping up my salary but only to 75%.

You are entitled to any holiday you have accrued to be paid at the full rate though.

If you stay on furlough until the end of your notice then yes presumably you would stay on 75%. If at any point during your notice period, you come off furlough and return to working then you go onto your usual salary. If they put you on “garden leave” so they can put someone else in your role while you wait out your notice, then I would expect that to be full pay.

If you hand your notice it and they keep you on furlough until you finish your notice, but you feel that they would have had you back in work if you hadn’t handed your notice in and have instead given your work to someone else because you’re leaving then you could possibly argue that you are in fact on garden leave rather than furlough but it might make leaving end on a bit of a sour note.

I’m in this situation, currently in my notice period but will remain on furlough throughout (would’ve still be on furlough regardless whether I was leaving or not). Will stay on my furlough pay, though at the end they will need to pay me my annual leave at my usual rate, including Bank Holidays that happened during furlough (not sure if that’s a part time thing though as a calculation of BHs forms part of my leaving allowance). Good luck with the interview.

Make sure your employers didn’t tell you to take annual leave during furlough pro data with your entitlement. Most sensible ones did this for people on furlough and working from home.

We made our factory cleaner redundant whilst he was on furlough and the 3 month notice period has to be paid at full rate although we are able to claim 80% furlough. not sure if this would be the case if he had handed in his notice though 🤔

Couldn’t you use this as an opportunity to negotiate a shorter notice period with your current employer?

Thank you everyone for taking the time to reply.

It's nice to know where I would stand and also useful to know my annual leave would need to be paid to me at my standard pay rate (inc the Bank Holidays I "missed").

My employers have not asked me to take any accrued holiday whilst on furlough, only said I can take holiday if I want to, so if I was paid instead of taking holiday that will be a nice chunk of money which will come in handy.

If I am successful at interview I will probably ask for my notice period to shortened so I won't have to go back at all and can start the new job (fingers crossed) earlier.

Better go smash that interview Grin

Just a quick clarification on the payment of annual leave - dependant on your terms and conditions, your employer could specify that you take your annual leave as part of your notice period. So, if you are on 12 weeks notice, and for arguments sake, you have four weeks worth of annual leave accrued, you could be paid your furlough entitlement for the first 8 weeks, then your outstanding holiday pay, at your standard pay rate, for the final 4 weeks. As employers will be responsible for NI and pension payments for furloughed staff from 1st August, this might be financially beneficial for them, and therefore the route they take. Possibly worth checking with your HR / payroll department.
