Called back to work but no school for DS

Does anyone know anything about employment rights currently as I've been called back to work on Monday but my DS isn't yet back to school in the published year groups.

His own school won't take him. And as he hasn't been there since lockdown i think it would be unhealthy for him to be dumped back there with no normal routine or friends.

I can't take him to work - it's a school! I work in administration.

Feeling stuck. Had this pushed on me now for Monday.

Yes I guess so but DS school have categorically stated they won't take new back to work parents. Only those from the beginning who had to work.

Surely they are the perfect organisation to understand about your predicament.

The school has to take him. My school are expanding provision for key worker children for this very reason. The government have said schools need to encourage key worker children to return.

His school should really take him, our very small school has very flexible rules regarding childcare. One of the parents isn’t a key worker and her child has a place, I would speak to the head.

As a key worker he is entitled to a place and they cannot say no. Call the LA and they will sort it out for you.

I'm feeling in a panic.
DS is a smart boy and finds school boring at the best of times. He would hate the low bare minimum input of teaching even if I didn't want to have a row with his head to take him.

Do I have any rights to not go back until DS goes back?

Presumably you didn't previously need the place and now you do. Di your son's school seriously expect you to send him in when you didn't need to?

You need to go back to work and are entitled to childcare so I doubt you have any particular right not to go back (no one has to go to work) - you're the same as any other keyworker.

I've been working at home all this time.

I can't socially distance either my colleagues desk is 20cm away from mine

You either need to put up a fight to get your son the school place he’s entitled to as you’re a key worker, or you need to resign from your job. I agree with the above poster that you will have to go through your LA if your sons school are being difficult. Are the two schools in the same LA?

You can’t say that you don’t want to go back through choice, and still expect to get paid.

If he is smart and gets bored at normal school lessons, maybe he won't under these circumstances with more freedom to do something he is interested in, rather than sit through the boring lessons.

Have you asked how social distancing will be in place in your office?

Email the school and say you can either come in, and he go into school, or you need to stay off.

Op, it’s up to your employer. I think you’d need to provide evidence the school are refusing to take him and I’d suspect that the head will speak to that head to ensure it’s the case. So be care ful with what reason you use.

If it’s more you don’t wish to send him back and don’t want to go to work and the school will take him you’ve just never explained to them your role and properly asked. Then your employer would be within their rights to ask you to take a short period of unpaid leave and then move to termination as they will need to employ someone else to do your job.
