Eggs stored when too old to use... is there any way around this???

A question for a friend really, just thought I'd ask the wise folk of mn.

Basically this lovely couple have been involved in planning a surrogacy for 8 months and have just now been told that when 'Helen's' eggs were stored in the first place she was too old at 38. They have now been told that there is a blanket policy not to use eggs from any woman over 35 (downs risk I think). They accept that there is an increased risk of downs, but are happy to take the risk.
This couple have a surrogate mother in place and this has come as a bombshell. They are absolutely devestated.

They would be such amazing parents, it's such a terrible shame.

If that's a clinic policy it's worth asking around as different clinics have different age limits. Do they belong to an organisation like COTS or Surrogacy UK who could give advice?

the risk of downs at 38 is still pretty tiny, i think around 1 in 225. most ivf is done in plus 35s and i've never heard of such a policy.
