deep cut and broken skin on my boy face

my boy has deep scratches on his face at the nursery do you think i should sue the nursery and i worried about his scars. what should i do

I would find out what happened, and use some bio oil if you are worried about scars.

Treat the scratches there is no need for them to scar

Suing the nursery wouldn't be my first choice no.

How did he get the scratches?

We're the nursery derelict in their duties in some way?

Do you intend to still use the nursery as suing them certainly won't help your relationship?

Can you show a picture of the cuts and scratches, close up so we don't see his whole face.

Did you seek medical treatment? Is he ok? Have you raised it with the nursery and will he continue to attend?

Unless there is a glaring safeguarding issues which led to an incident and harm suing is not going to resolve anything. If you have safety concerns Ofsted or Early Years department at the LA is your route to report.

I would think you would need to prove negligence, that they will result in permanent scarring and you took and followed medical advice to reduce risk of scarring.

There is a legal board who might be able to help if you are considering action.

I don’t think you can sue the nursery. If you think there has been negligence/ have safeguarding concerns then by all means report to ofsted for them to investigate and if you don’t like the way they care for your son obviously look for another nursery, however I don’t think you can sue unless you can prove negligence and a serious fault. You would also need to prove that the injury was going to have a significant detrimental physical, psychological and/ or financial effect on your son; a small scar of two isn’t going to be considered significant enough to be of concern.

Did the cuts receive hospital treatment and have they now been closed up? I would follow the doctors advice regarding how to care for the cuts but generally if you keep a wound covered and don’t let it air dry it will reduce scarring. Once the cuts have started to heal over you can use products such as bio-oil or silicone sheets to help reduce scarring.
