No, not unless you are a temporary maternity type nanny. The definition of a nanny fitls employment, not self employment.

For example are you able to dictate hours, set your own rates and provide another person to work in place of you should you wish to plus provide all your own materials etc?

Hopandpop · 05/06/2010 20:23

i could dictat te hours and i am dictating my own rates too.

i suppose i could find another nanny if needed, she will need me for 12 months while she studys.

i am willing to work for less then minimum wage as im taking my own children round to hers too

is it illegal to do this self employed.

couldn't you mind her children at your house?

frakkit · 06/06/2010 10:03

Agree why can't you mind her children if you're already a registered minder?

If HMRC find out your friend faces a £3k fine plus they'll want backpayment of tax and NI.

Hopandpop · 06/06/2010 21:31

oh i see i would want to do it all legit, her house is bigger and better equiped and of course less paperwork then with my normal childminding.

i can childmind them here though, im re decoratigna dn better equiping mthouse so should still work as well, just would have been nicer in her huge airy house, suppose we could go for trips home when my walls get boring :D
thanks everyone

You could transfer your childminding registration so that the place was her house - I think. You certainly used to be able to register to childmind from a premises that you didn't occupy yourself. Bit complex though and would involve you caring for other children at her house in addition.

Is the other minder giving up her registration? I wonder if she could employ you as her assistant... hmm, not sure... possibly.
Nah... that still makes you an employee.

Why can't she just employ you as a nanny? If using funding via college / tax credits, you would need to be registered (vOCR in England).

Hopandpop · 06/06/2010 21:55

im already her assistant in all senses but work alongside her with flexible hours so works well with my own children,

i am a registered minder

i will put it to her to employ me i dontthink it will be hard to sort out i alreadypay the normal ni payments.

will jut have to look up what we need to do for her to employ me

thnkas

HMRC: Employee starting / leaving

Maybe worth you having a chat with other childminders who have co-childminders. I'm not sure if a co-childminder is an employee, or not. Katymac may be able to help.
