Ofsted - 'rising 5' clause and own ds - does anyone know???

My own son started ft school last Sept and at the time I came out of cm'ing to work in a playgroup but am now back. I had the 'rising-5 clause' added to my registration last year to cover me for a child in reception, which states I can care for 2 children in the Early Years age group - my own son at the time being the third child.

I've asked them to amend my registration to reflect the fact my son is in ft education, expecting them to amend it to 3 under5's, but no more than 5 under8's (ds being the 6th). However, got a call from Ofsted today telling me that my own son is still classed as my rising-5 and that, yes I can have another child in the early years while he is at school, but not before/after school or during school holidays. They added that I can apply for the variation after his 6th birthday in November - even though EYFS only applies until 31st August, although I dont have to follow EYFS for him.

I've had an enquiry for a child 3days a week and if this is the case will have to turn them away, given the numbers/hours I already have. Financially, I need the work. My only other option would be to put my ds with a cm before and after school - how crazy is that, and how upset will he be that mummy is looking after other children but not him! .

Can anyone shed any light on this for me? Has anyone else had the same situation? Is this Ofsted making it up as they go along again?

Genuinely intrested, and not trying to stir or any thing,
But what is you actully do Virus, are you an Ofsted Inspector, or work in the call center, Head of nursery or pre school or similar?
To me, your words come across as being very harsh and rather condesending.

eerrrm, virus, I have had the rising 5 clause on my registration since March last year, am very aware of legislation - especially since my insection last year - but the new ruling on cm's own children being in full time education was only published by Ofsted in March this year.

You have the tone of someone who had another thread on here pulled not too long ago..... . Think I know who you are!

as to Virus' comments, well WE all know the rising 5 rule it appears that dopey ofsted don't though as they have given 3 - yes three different explanations of it - in writing.
If you have a look at other forums you will see that Ofsted appear to give conflicting, inconsistent and frankly WRONG information to people making them appear inept. It really does depend on who you talk to, at what time of day and if you ask them again in another phone call you will get different information yet again.
And don't even get me started on unfair, judgemental, unknoweledgable and often biased inspectors

so Virus put your money where your mouth is and tell us - what experience do you have with Ofsted that we don't.

Thread LT was about an online 'community' and 'resource centre' for cms that one of our online colleagues had innocently asked for opinions on - and it was hijacked by a certain person??? Bout 4wks ago??? Remember it well - my hackles were raised for days afterwards .

And Pippin- gonna change my name to Clouseau, lol!

Oh, I probably missed that because I was on holiday! I started a thread which would probably drive Virus mad (was a couple of years ago and ALL ABOUT Ofsted - shall I bump! lol)

Oh and 2 first aid kits, what a fab idea!!

heck looney that is terrible, I presume you had an awful inspection?
I suppose that Virus could always start a thread that highlights the benefits and virtues of ofsted .
